Responsibility for Providing Care and Supervision — LPA Wheatley observed three children napping without supervsion inside of an enclosed classroom. This poses an immediate Health and Safety risk to the health and safety child in care.

Food Service — Director's acknowledgement that on at least one occsasion, the child in care was served food indicated in her file as an allergen, which posed an immediate Health and Safety risk to children in care.

Personal Rights — The child in care suffered a dislocated elbow in care, and LPA Clayton's observation of teacher S1 pulling children by the wrist, and arm, which poses and immediate Health and Safety risk to children in care.

Reporting Requirements — LPA Wheatley was informed by the director and other witness that Child #1 was injured with scissors while at the day care. The child was taken to the doctor. The injury was not reported to Licensing. This poses a potential risk to the immediate Health and Safety risk to the health and safety child in care.

Health & Safety Code- 1596.808 Beverages served by day care providers to children; requirements; exceptions for medical needs and beverages provided by parents or guardians; updated guidelines; inspections to determine compliance. Commencing January 1, 2012, except as provided in subdivisions (b) and (c), a licensed child day care facility shall comply with all of the following requirements for beverages served by the day care provider to children in the provider’s care: (1) Whenever milk is served, serve only lowfat (1 percent) milk or nonfat milk to children two years of age or older. LPA Wheatley inspected the refrigerator and observed 2% milk inside of the refrigerator. This is a Type B violation. The milk required is 1%. This poses a potential risk to the Health and Safety of child in care. — requirement not met

Personal Rights — LPA Clayton's observation of the staff forcing the children to sleep and forcing the children to wake up from their nap which poses a Health and Safety Risk to children in care.

Activities/Napping — LPA Clayton's observation that the children in the Dolphin class are not having their toileting/diapering needs addressed until a another teacher arrives at 10am, which posed a Health and Safety risk to children in care.

Reporting Requirements — LPA Clayton interviews revealed that the student bit a teacher, which required medical attention and the incident was not reported to the parent or the department in the time frame outlined in the above mentioned regulation, which posed an immediate Health and Safety risk to the child in care.

Teacher Aide Qualifications and Duties — LPA Clayton record review of the staff file and the inability to veriry the education requirement was met, and LPA Clayton observed the staff supervising children in the absence of a fully qualified teacher.

Personal Rights — LPA Clayton's observation of staff repeatedly send a child outside without assessing the child’s needs, (eating, toileting, etc.) which is a violation of the child’s personal rights.
