101161(a) Limitations on Capacity: A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. Based on observation, interview, and record review, the licensee did not comply with the section cited above in that, one (1) infant was comingling in the preschool, which poses an immediate health, safety or personal rights risk to persons in care.

Teacher-Child Ratio — Based on staff and parent interviews, the licensee did not comply with the section cited above. LPA interviewed six staff. Three out of six staff stated they have been out of ratio. Four out of six staff interviewed stated they have witnessed other staff being out of ratio. On 9/12/2024, LPA reviewed records where a teacher had informed the front office staff they were out of ratio. One out of the three parents interviewed stated they have observed one staff caring for 13 to 14 children alone in the morning during drop-off which poses an immediate health, safety or personal rights risk to persons in care.

Criminal Record Clearance — Based on observation and interview, staff Chloe Doyle was observed in classroom 121 with 13 preschol age children and did not have criminal record clearance. This poses an immediate safety risk to to children in care.

101212 Reporting Requirements (d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. This requirement was net met by: Based on the facility not reporting the incident regarding C1 injury and being unable to provide documentation showing the incident was reported to CCLD, this poses a potential safety risk to children in care.
