Family home — in-ground pool drowning prevention requirements — Based on observation and measurements, the licensee did not comply with the section cited above which poses a potential health, safety or personal rights risk to persons in care. At 9:51 AM, LPA observed that although the wrought iron fence isolates the swimming pool and the gate swings away from the pool, is self-closing, and self-latching, the key lockable device is 58 inches above the ground.

At 9:49 AM, LPA observed that although the wrought iron fence isolates the swimming pool, the vertical clearance from the ground to the bottom of the enclosure is greater than 2 inches in some areas of the enclosure; on the left of the gate on the grass area and on the section of the gate where the gated door is located there were areas that measured 3.75 inches.

At 9:52 AM, LPA observed that that there is one gap or void spaces that is 5 inches wide which would allow the passage of a sphere with a diameter of 4 inches wide; this area is on the right of the gate where the wrought iron gate meets the cinder block wall.
