100700(c)(1): A licensed child day care center, as defined in Section 1596.76, that is located in a building that was constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test. — Based on record review, the facility did not comply with the section cited above as the Lead testing was not done until April 12th, 2023 after the required due date of January 1st, 2023, which posed a potential health, safety or personal rights risk to persons in care.

101700.3 California Lead Action Level at Child Care Centers: (b)(2): "Licensee shall maintain a lead value at or below the Action Level of 5.5ppb in all outlets subject to the testing requirements of these Written Directives, for the health and safety of children in care" — Based on results received from the certified water samplers, the facility exceeded 5.5 ppb of lead in their water source In classrooms #1, #2, and Staff Room. Once received, the facility took immediate and proper actions to remediate the fixtures. This poses a potential health, safety, or personal rights risk to persons in care.
