101223 Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (1)To be accorded dignity in his/her personal relationships with staff and other persons. (2)To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This reequirement was not met as evidenced by: Althohugh staff denied pulling the child's ear, she admitted to grabbing a child's ear while preparing to go on a field trip which poses a potential risk to the health and safety of children in care.
Drinking water lead testing — Based on interview and record review, the licensee did not comply with the section cited above in that the center has not had it's drinking water tested for lead which poses/posed a potential health, safety or personal rights risk to persons in care.
Personnel Requirements — Based on record review, the licensee did not comply with the section cited above in that 5 out of 5 staff did not have a current proof of CPR/1st Aid training certification on file today which poses a potential health, safety or personal rights risk to persons in care.
