Responsibility for Providing Care and Supervision — Based on staff interviews. S3 disclosed he/she observed C1 scratching and applied ointment and left work before noon leaving the child under the supervision of staff who did not meet C1’s needs. The child incurred injuries. This poses an immediate risk to the health, safety, or personal rights of children in care.

Criminal Record Clearance — Based on records reviewed and interviews conducted, the regulation was not met. Lina Watban did not have clearance and was observed providing care and supervision, which poses an immediate risk to the health and safety risk to children in care.

Infant Care Food Service — Based on records and interview statements, the individual infant feeding plan was not updated to reflect the changes in the C1’s dietary plan, which poses/posed an immediate risk to the health of the children in care.

Personal Rights — Based on records and interview statements, staff stated that C1 got a hold of restricted food that caused C1 diarrhea on two or more occasions. The staff did not prevent the child from eating restricted food. This poses an immediate risk to the health of the children in care.

101223(c) Personal Rights: The licensee shall ensure that each child is accorded the personal rights specified in this section. The licensee did not comply with the above regulation as evidenced by: Based on interviews and records review, the licensee did not comply with the above regulation, which posed/posses an immediate risk to the health, safety, and personal rights of clients in care. A witness disclosed they observed a staff force force-feeding an infant in care.

101439.1(f) Infant Care Center Sleeping Equipment. Cribs shall be free from all loose articles and objects, including blankets and pillows. The licensee did not meet the regulation above as evidenced by: Based on observation, the licensee did not meet the regulation above in 6 out of 6 cribs. The LPA observeed 5 infants sleeping in cribs that contained loose articles.

Reporting Requirements — Based on records and interviews, the staff did not report C1’s condition. Staff admitted they did not report as required. This poses a potential risk to the health, safety, or personal rights of children in care.

HSC 1596.8595(c)(1) … reports to be provided to parents or guardian … facility shall provide to the parents … copies of any licensing report that documents any Type A citation that represents an immediate risk to the health, safety, or personal rights of children … This regulation was not met as evidenced by: Based on interview statements and records review, the facility administration failed to give parents copies of one or more licensing reports that document a Type A citation. Upon records review, the LIC9224 forms were missing or unsigned. Staff admitted they did not provide the required reports to parents. This represents a potential risk to the health, safety, or personal rights of children in care.

Infant Care Activities — Based on records review, the licensee did not comply with the section cited above in two of two infants under twelve months old who did not have an LIC9227, which poses/posed a potential health, safety or personal rights risk to persons in care. The two infant files did not have an LIC9227; both infants were under 12 months old.
