Responsibility for Providing Care and Supervision — Based on the interviews and a video provided, the licensee did not provide the level of care and supervision to meet the needs of a child resulting in another child being harmed. This poses an immediate health, safety, or personal rights risk to persons in care.

The licensee shall ensure that each child is accorded the following personal rights: (1) To be accorded dignity in his/her personal relationships with staff and other persons. This requirement was not met as evidenced... Based on interviews and video obtained, the licensee yelled in the presence of children. And yelled directly at a child during nap time in the presence of children and teachers. Which poses an immediate health, safety or personal rights risk to persons in care.

Personal Rights — Based on interviews it was found that staff members had pinched a child’s cheeks, lifted a child under their armpits above the ground, and had pulled a child’s hair and backpack. Which poses an immediate risk to the health safety or personal rights of children in care.

Responsibility for Providing Care and Supervision — , the facility self-reported two absences of supervision. The first (C1) occurred at 10:00 AM and (C2) occurred at 11:00 AM. This poses an immediate health and safety risk to children in care.

(a)The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to..con't line 8 interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. Based on investigation interviews, staff made an inappropriate comment in the presence of a day-care child.

Neglect/Lack of Supervision-Facility failed to pick up child from school on time The licensee shall provide care and supervision as necessary to meet the children's needs. — requirement not met

Request a transfer of a criminal record clearance as specified in Section 101170(f). This requirement has not met as evidenced: Staff Andrea Perkiss and Cassandra Gonzales have not been associated with the facility as required. This is an immediate risk to the health and safery of children in care. A civil pentaly in the amount of $200.00 is assessed.

The licensee shall ensure that each child is accorded the following personal rights: (1) To be accorded dignity in his/her personal relationships with staff and other persons. This requirement has not met as evidenced: Staff #1 forcefully took a cup away from Child #1 while the child was still drinking, and Staff #1 took the child's cup, they forcefully grabbed and pulled Child #1's arm to join the group. Staff #1 said loudly and aggressively "The blanket is mine until you are settled down!", "Stop!", "Be quiet!" while the children were settling down on cots.This is an immediate risk to the health and safery of children in care.

Responsibility for Providing Care and Supervision — multiple witness statements that a child (Child1) was left unattended on the playground for one to three minutes. This incident was self-reported by the facility. This poses an immediate health and safety risk to children in care.

TrustLine provider denied based on a background check result — Based on interview and record review, LPA learned that the fire drill log was falsified, which poses an immediate health, safety or personal rights risk to persons in care.

Indoor Activity Space for Infants — Based on observation, the licensee did not comply with the section cited above in that LPA observed school-agers, infants, and preschoolers in the cafeteria together, which poses/posed a potential health, safety or personal rights risk to persons in care.

101216.2 Teacher Aide Qualifications and Duties (c) Verification that an aide who is less than 18 years old meets the qualifications required in (b)(1) or (b)(2) above shall be obtained and kept at the center. This regulation was not met as evidenced by: Based on observation, a 17-year-old aide, who has not graduated high school and is not enrolled in a work program, was supervising children alone, which poses an immediate health, safety, or personal rights risk to children's in care.

Parent right of entry — Interviews and documents provided revealed that two parents were not allowed to enter the facility. This poses a potential health and safety risk to the children in care.

(a)(1) In child care centers providing meals to children, the following shall apply: (1) All food shall be safe and of the quality and in the quantity necessary to meet the needs of the children. — requirement not met

The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. This requirement has not met as evidenced: part of the fencing not being fully submerged into the ground leaving sharp wires protruding, and fence sections in a Junior Pre-School age component that have been repaired with wiring, some of the wiring is sharp to touch. This is a potential risk to the health and safety of children.

Each child day care facility shall maintain a current roster of children who are provided care in the facility. The roster shall include the name, address, and daytime telephone number of the child's parent or guardian, and the name and telephone number of the child's physician. This roster shall be available to the licensing agency upon request. This requirement has not met as evidenced: the facility representatives were unable to provide a current facility roster to LPAs at the time of the inspection.

All toilets, handwashing and bathing facilities shall be maintained in safe and sanitary operating condition. This requirement has not met as evidenced: LPAs observed water leaking urinal piping in two of children's bathrooms. This is a potential risk to the health and safety of children.

101170 Criminal Record Clearance (b)(2)(B) The volunteer spends no more than 16 hours per week at the facility. This regulation was not met as evidenced by: Based on interview and record review, LPA learned that Volunteers work more than 16 hours per week, which poses a potential health, safety or personal rights risk to persons in care.

Parent right of entry — Based on interviews, the licensee did not allow parents or authorized representatives to enter beyond the lobby, which poses a potential health, safety, or personal rights risk to children in care.

1596.866 Additional health and safety training; condition of licensure (b)Day care center directors...shall ensure that...one staff member who has a current...pediatric first aid and pediatric CPR...shall be present with the children when children are offsite. This regulation was not met as evidenced by: Based on record review, Staff 1, who provides transportation, does not have a current pediatric first aid or CPR certification, which poses a potential health, safety, or personal rights risk to children in care.

Written directives for drinking water lead testing — Based on record review, two faucets tested exceeded the allowed 5.5 ppb, which poses/posed a potential health, safety or personal rights risk to persons in care.
