(b) For a Small Family Child Care Home, the maximum number of children for whom care may be provided at any one time, including children under age 10 who reside at the licensee's home, shall be one of the following:…………(3) More than six and up to eight children, without an additional adult attendant,……..(c) The total licensed capacity for a Small Family Child Care Home shall not exceed eight children. (e) If no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home as specified in subsections (b) and (c). This requireement was not met as evidenced by: LPA Clayton's observation of one teacher supervising 11 children, and the other teacher had left the property, and returned within 5 minutes, which poses a potential health and safety risk to children in care.

(d) Prior to employment or initial presence in the child care home, all employees and volunteers subject to a criminal record review shall:(1) Obtain a California clearance or a criminal record exemption as required by law or Department regulations or (2) Request a transfer of a criminal record clearance as specified in Section 102370(j) or This requireement was not met as evidenced by: LPA Clayton checked the facility roster in the Guardian Background Check System and observed that assistant Melinda does not have a fingerprint submission on record in Guardian or LIS, which poses a health and safety risk to children in care.

TrustLine provider — registry record not kept current — The interview conducted by the departments Investigations Branch revealed that an employee at the family child care was the suspect in multiple crimes against children across the United States, which posed an immediate Heath and Safety risk to children in care.

(a) The licensee shall be present in the home and shall ensure that children in care are supervised at all times. When circumstances require the licensee to be temporarily absent from the home, ..... absence. Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day.

(f)(1)"Family Day Care" or "Family Child Care" means regularly provided care, protection and supervision of children, in the care giver's own home,.......while the parents or authorized representatives are away. The term "Family Child Care" ....... (h)(1)"Home" means the licensee's residence as defined by Government Code Section 244. (a) It is the place where one remains when not called elsewhere for labor or other special or temporary purpose, and to which he or she returns in seasons of repose. (b)There can only be one residence.

Family home — children supervised at all times — LPA Clayton's arrival to the Family Child Care home before operating hours began and remaining at the home until 2:45pm during which time the Licensee Albina Baranova never arrived which poses a Health and Safety risk to children in care.

Family home — home free of safety hazards — Based on LPA Clayton's observation and record review, the licensee did not comply with the section cited above regarding conducting fire drills and disaster drill at least once a month, in which poses a potential health, safety or personal rights risk to persons in care.

Family home — children supervised at all times — Based on LPA Clayton interview with staff, that the licensee did not comply with the section cited above regarding absences not exceeding 20 percent of the hours that the facility is providing care per day, which poses a potential health, safety or personal rights risk to persons in care.

Mandated reporter training — Based on LPA Clayton's observation and record review, the licensee did not comply with the section cited above in which poses a potential health, safety or personal rights risk to persons in care.

Family home — preventive health training, including pediatric CPR and first aid — Based on LPA Clayton's observation and record review, the licensee did not comply with the section cited above in which poses a potential health, safety or personal rights risk to persons in care.

Immunizations — Based on LPA's record review, the licensee did not comply with the section cited above which poses a potential health, safety or personal rights risk to persons in care.

102421 Child's Records (a) The licensee shall maintain, in each child's record, the signed and dated notice form required in Section 102419(d). This requirement has not been met as observed by LPA Clayton review of 13 children’s files, and 7 were found to be out of compliance as 3 files are missing the Consent for Medical Treatment – LIC627 and 4 files have the incorrect Consent form (the files contained the consent form for Adult and Elderly Residential Facilities – LIC 627C)

Family home — home free of safety hazards — Based on LPA Clayton observation, the licensee did not comply with the section cited above as evidenced by the cabinet in the kitchen where which household cleaning products are stored has a broken child safety lock which poses a potential health, safety or personal rights risk to persons in care.

Family home — home free of safety hazards — Based on LPA Clayton record review the licensee did not comply with the section cited above as evidenced by staff admission the they do do not conduct disaster drills with the children, which poses a potential health, safety or personal rights risk to persons in care.

Child's Records — Based on LPA Clayton observation and record review, the licensee did not comply with the section cited above only 3 of the 6 children in care have a file on hand for review at the time of the inspection which poses/posed a potential health, safety or personal rights risk to persons in care.

Family home — clean, safe, heated and ventilated — (b) The home shall be kept clean and orderly, with heating and ventilation for safety and comfort. Based on LPA Clayton observation the licensee did not comply with the section cited above as evidenced by mouse dropping in the bathroom cabinet, and the kitchen and refridgerator needing to be cleaned which pose a potential health, safety or personal rights risk to persons in care.
