Responsibility for Providing Care and Supervision — Based on interviews and observation, C1 and C2 have been unsupervised on multiple occasions and LPA observed children unsupervised during the inspection

Reporting Requirements: Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours... Any unusual incident... that threatens the physical or emotional health or safety of any child. This requirment was not met as evidence by... Based on interviews conducted the director did not report the termination of a former staff member who had inappropriate conduct with children outside of the facility. This poses a potential health and safety risk.

Personal Rights: Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized... To receive safe, healthful and comfortable accommodations, furnishings... — Based on interviews conducted it was disclosed by S1-S3 and C1-C2 that S1 and S4 were involved in a verbal altercation in front of children. This poses a potential health and safety risk to children in care.

Buildings and Grounds — Based on observations the licensee did not comply ,with the section cited above . During the tour LPA observed black, brown , yellow stains and holes on the carpet . Water dispencer had stains and dust . LPA observed couch cushions soiled , which poses/posed a potential health, safety or personal rights risk to persons in care.

Staff immunization requirements — Based on records review and interview , the licensee did not comply with the section cited above . LPA reviewed 5 satff files and observed 3 staff members were missing records of immunization , which poses/posed a potential health, safety or personal rights risk to persons in care.

Personnel Requirements — Based on the records review , the licensee did not comply with the section cited above. LPA reviewed 5 records and 2 out of 5 were missing Health Screening reports , which poses/posed a potential health, safety or personal rights risk to persons in care.
