101223(a)(3) Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from… infliction of pain… or other actions of a punitive nature… This was not met as evidenced by: Based on interview and UIR submission, Staff lifted a child from the floor improperly, they lost their grip, resulting in the child falling backwards, bumping their head on the floor. This poses and potential health/safety and personal rights risk to children in care.
Personal Rights — Based on record review and interviews, the facility did not provide a child with adequate diapering changing on at least one occasion during the week of 04/20/25. A staff member left a wet diaper on a child, twice in one hour, which poses a potential health, safety or personal rights risk to persons in care.
Outdoor Activity Space — Based on interviews and LPA observation, the facility did not provide a shaded rest area for children during outdoor activities, on at least one occasion during the week of June 09, 2025, which poses a potential health, safety or personal rights risk to persons in care.
Buildings and Grounds — Based on LPA observation the licensee did not comply with the section cited above in that LPA observed the following areas with debris: toilets, sink, gates, carpets, tables, chairs, and floors which poses/posed a potential health, safety or personal rights risk to persons in care.
Staff immunization requirements — Based on observation and record review, the licensee did not comply with the section cited above in one out of two staff files reviewed. Staff #1 did not have immunization records for review, which poses a potential health, safety or personal rights risk to persons in care.
Personnel Requirements — Based on observation and record review, the licensee did not comply with the section cited above in one out of two staff files reviewed. Staff #1 did not have health screeing (LIC503) or records of TB test results for review, which poses a potential health, safety or personal rights risk to persons in care.
