This regulation was not met as evidenced by: Based on interviews and records reviewed, several day care children displayed aggression towards other day care children on multiple incidents that occurred at the facility between 08/07/2024 through 12/17/2025, which is an immediate risk to the health and safety of children in care.

Responsibility for Providing Care and Supervision — Based on observation and records reviewed, facility staff failed to provide proper care and supervision for a child that was not within direct site of staff, on the opposite side of playground area. This poses an immediate health, safety and personal rights risk to children in care.

101223(a)(2) Personal Rights, (a) The licensee shall ensure that each child is accorded the following personal rights: 2)...safe, healthful & comfortable accommodations, furnishings & equipment to meet his/her needs.This regulation was not met as evidenced by: Based on evidence gathered through observation, interview & record review, the licensee failed to ensure personal rights of person's in care, due to subject child's acts of aggression towards children and staff, which is a potential risk to the health & safety of persons in care.
Mandated reporter training — Based on the record review, the Licensee did not meet the above regulation which poses a potential safety risk to the children in care. During the file review for staff the LPA was unable to review a current Mandated Reporter certificate for S5.
Health-Related Services — Based on the observation and record review, the Licensee did not meet the above regulation which poses a potential health risk to the children in care. During the facility tour the LPA inspected the medication stored at the facility. The LPA observed expired medication for children who are currently enrolled.
Mandated reporter training — Based on record review, the licensee did not comply with the section cited above in 3 out of 5 staff files which poses a potential health, safety and personal rights risk to persons in care.
