Admission Agreements — Based on documentation reviewed and interviews conducted, the Department determined that the facility failed to follow its established policies and procedures regarding the disenrollment of Child 1 (C1) by never completing the family pledge/ engagment packet.
(b) At the time of acceptance of each child in care, the licensee shall inform each child's parent or authorized representative of his/her rights that include, but are not limited to, the following: (5) To complain to the local licensing office and inspect the child care center without discrimination or retaliation in accordance with Health and Safety Code Section 1596.857 Based on interviews and documentation reviewed, the Department determined that C1's guardians were subjected to retaliatory treatment after filing a complaint and expressing concerns regarding the facility. As a result, the family was prevented from enrolling C1 at a nearby sister center. The evidence supports that the denial of enrollment was influenced by the guardians' prior complaints and interactions with facility staff rather than by objective enrollment criteria.
Mandated reporter training — Based on record review, the licensee did not comply with the section cited above in two of five staff files audited. Where S1 and S3, did not have a current Mandated Reporter certificate on file. Which poses a potential health, safety or personal rights risk to persons in care.
Responsibility for Providing Care and Supervision — Based on two of two interviews and records reviewed, C1 was left alone at the end of a hallway for approximately five or more minutes. C1 was located when appropriate name-to-face documenation was reviewed. Which poses a potential health, safety and/or personal rights risk to children in care.
Teacher Qualifications and Duties — Based on interview and record review, the licensee did not comply with the section cited above in one out of five staff files. Where Staff 5 (S5) did not have transcripts available for review during inspection. Which poses a potential health, safety or personal rights risk to persons in care.
Teacher-Child Ratio — Based on observation, interview and record review, the licensee did not comply with the section cited one out of three preschool classrooms observed. Where the 4's classroom had 22 children present with one fully qualified staff and an assistant, exceeding a maximum of 15 children. Which poses a potential health, safety or personal rights risk to persons in care.
