101223 Personal Rights (a)The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirment was not met, as evidenced by: Based on the interview and record review, the Center did not comply with the above regulation. A staff member pulled C1’s hair to demonstrate how it felt when C1 pulled others’ hair. This intention violated the child’s personal rights, which poses a potential health and safety risk to the children in care.
Written directives for drinking water lead testing — Based on results received from the certified water samplers, the facility exceeded 5.4 ppb of lead in their water source. Once received, the facility took immediate and proper actions to remediate the fixtures. This poses a potential health, safety, or personal rights risk to persons in care.
