Personal Rights: (a)The licensee shall ensure that each child is accorded the following personal rights:(1) To be accorded dignity in his/her personal relationships with staff and other persons. This was not met as evidenced by: A staff admitted to making comments that violated the rights of children. The staff stated they made negative remarks of the way a child was presented to the center. The staff stated they were unaware that this was a violation of the child's rights. The child is no longer enrolled. This poses a potential risk to the health and safety of children.
Buildings and Grounds — Based on observation, the licensee did not comply with the section cited above in that there were two sani disinfecting wipe containers in room C16, a hand sanitizer bottle on a shelf at the entrance of room C6 and a hand soap container in the outside boys restroom that was not in a key locked area which poses a potential health, safety or personal rights risk to persons in care.
Modifications to Infant Needs and Services Plan — Based on record review, the licensee did not comply with the section cited above in that C3 and C4 did not have an updated Needs and Services Plan form which poses a potential health, safety or personal rights risk to persons in care.
Personal Rights — Based on the interview and record review, the facility did not meet the Personal Rights regulation which poses a potential Personal Rights risk to the children in care. There were at least 8 biting incidents over the course of 5 weeks, documented that were not prevented by the facility involving the same child, Child 1 (C1).
