Responsibility for Providing Care and Supervision — Based on interviews and records review, licensee did not comply with the section cited above, as it was confirmed that Child #1 (C1) entered the classroom without adult supervision and remained inside the classroom unsupervised until a daycare parent found C1 alone. This poses an immediate risk to the health, safety, and personal rights of children in care.

Personal Rights — Based on interviews, the licensee did not comply with the section cited above. During the investigation, LPA conducted interviews, and it was confirmed that staff member yelled at and handled a daycare child in a rough manner. This poses a potential health, safety, and personal rights risk to children in care.
Personnel Requirements: (k) The licensee or designated individual shall instruct all personnel to report observations or evidence of violations of any of the personal rights specified in Section 101223. Based on observation, the licensee did not comply with the section cited above. During the interview, it was disclosed that a staff member observed a child who was crying, upset and child disclosed that child bump child’s head. The incident was not reported to the designated individuals. It was discovered that child sustained another injury result from the fall that child bumped child’s head. This poses a potential health, safety, or personal rights risk to persons in care.
(e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: (2) Request a transfer of a criminal record clearance as specified in Section 101170(f) or Based on observation, the licensee did not comply with the section cited above. Based on the interview, it was disclosed that Staff #1 did not have his/her background clearance transferred to be associate with this facility. This poses a potential health, safety, or personal rights risk to children in care.
