Responsibility for Providing Care and Supervision — Based on interview and record review, the facility did not comply with the section cited above. A child was left unattended and unsupervised, posing an immediate health, safety, or personal rights risk to children in care.

Responsibility for Providing Care and Supervision — the interview and facility incident report. The staff failed to provide adequate supervision, which allowed C1 to leave the classroom without the staff's knowledge and was found alone in the play yard. This poses an immediate health and safety risk to children in care.

Personal Rights — Based on interview and Incident report, the director stated that the staff admitted to pull the back of the child’s sweatshirt over the back of the chair in a manner that prevented the child from standing, which poses/posed a potential risk to health, safety or personal rights risk to persons in care.

101223 Personal Rights (a)The licensee shall ensure that each child is accorded the following personal rights: (3)To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement is not met by: Based on interviews, obtained information, and record review, the facility did not comply with the section cited above which poses a potential health, safety, or personal rights risk to children in care.

Mandated reporter training — Based on the record review, the Center did not comply with the abovementioned section. Three out of Five staff members have not completed their Mandated reporter training, or the training has expired, which poses/posed a potential health, safety, or personal rights risk to persons in care.
