Personal Rights — Based on record review, the licensee did not comply with the section cited above in 1 staff pushed child which poses an immediate health, safety or personal rights risk to persons in care.

Responsibility for Providing Care and Supervision — Director stating a child was waiting in the front hallway as a parent was gathering his children for pick up noticed child was not part of his group and had child wait in front and not exit the door with his . This poses an potential health and safety risk to children in care.

TrustLine provider — registry record not kept current — Based on IB investiagtion, interviews and review of records IB reveled that the violent altercation between Staff#1 and Staff# 2 posed a risk to children and other staff; therefore, the allegation of conduct inimical is substantiated.

Criminal background check — Based on Licensee's disclosures of an uncleared adult volunteering/working in the facility since May of 2025, a civil penalty of $500.00 is being assessed and a Type A deficiency is being cited due to licensee not complying in having Adult #1 obtain a criminal record clearance which poses an immediate health, safety or personal rights risk to persons in care.

Fixtures, Furniture, Equipment and Supplies — Based on observation, the licensee did not comply with the section cited above in [1 trash can in hallway did not have a tight fitting lid which poses/posed a potential health, safety or personal rights risk to persons in care.

Mandated reporter training — Based on record review, the licensee did not comply with the section cited above in [3 out of 6 staff do not have Mandated Reporter Training which poses/posed a potential health, safety or personal rights risk to persons in care.

Staff immunization requirements — Based on record review, the licensee did not comply with the section cited above in [6 out of 6 staff do not have all the required immunization on file which poses/posed a potential health, safety or personal rights risk to persons in care.

Personnel Requirements — Based on record review, the licensee did not comply with the section cited above in 1 out of 6 staff do not have proof of TB Clearance out of total which poses/posed a potential health, safety or personal rights risk to persons in care.

(b) Prior to employment, a teacher shall meet the requirements of (b)(1) or (b)(2) below: (1) A teacher shall have completed, with passing grades, at least six postsecondary semester or equivalent quarter units of the education requirement specified in (c)(1) below; or shall have obtained a Child Development Assistant Permit issued by the California Commission on Teacher Credentialing. — requirement not met

(a) The licensee shall ensure that personnel records are maintained on the licensee, administrator and each employee. Each personnel record shall contain the following information: (12) Tuberculosis test documents as specified in Section 101216(g). — requirement not met

(c) Upon admission of a child into a drop-in childcare center, the child’s authorized representative shall sign an acknowledgment that they understand that verification of immunizations and tuberculosis testing is not required for any child accepted into a drop-in childcare center.

(b) The licensee may use teacher aides in a teacher-child ratio of one teacher and one aide for every 15 children in attendance. (1) A ratio of one fully qualified teacher (as specified in Section 101216.1(c) and one aide for every 18 children in attendance in a preschool program is allowed when the aide meets the qualifications specified in Section 101216.2(d). — requirement not met

(a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. — requirement not met

(a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. (2) The licensee shall safely dispose of water and any disinfectants/solutions that have been used for cleaning. — requirement not met

(f) Solid waste shall be stored, located and disposed of in a manner that will not transmit communicable diseases or odors, create a nuisance, or provide a breeding place or food source for insects or rodents. (1) All containers used for storage of solid wastes, including moveable bins, shall have a tightfitting cover that is kept on; shall be in good repair; and shall be leakproof and rodent-proof.

(1) The center shall give each authorized representative a copy of the Personal Rights form (LIC 613A [9/96]). — requirement not met

Reporting Requirements — Based on interviews and record review, The Facility did not notify Licensing of incident within 24 hours of incident, which poses a potential Health or Safety, or personal rights risk to persons in care.

Activities/Napping — during the tour, there was one staff with 19 children in Pre-K (A) and not all of the children were napping. This poses a potential risk to the health, safety or personal rights of the children in care.

Napping Equipment — During the tour, LPA and LPM observed that the cots in Pre-K(A) were positioned so that there was not a walkway between the cots without having to walk on or over the cots of other children. This poses a potential risk to the health, safety or personal rights of the children in care.
