101223 Personal Rights (a)The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature.... Based on records reviewed and interviews the facility did not comply with the regulation cited above. LPA Herrera obtained corroborating interviews, and documentation that revealed staff #1 threatened child #1 with scissors, which posed an immediate risk to the health, safety and/or personal rights to children in care.
Personal Rights — Staff 1 violated Child 1's personal rights on 01/11/2024. As stated in LIC9099 and LIC9099-C. This poses an immediate Health and Safety risk to children in care.
Type B(3)
(a) The licensee shall ensure that personnel records are maintained on the licensee, administrator and each employee. Each personnel record shall contain the following information: Based on record reviews 4 substitute staffmebers did not have a file at the facility for LPA to review. Which poses a potential health, safety or perosnal rights risk to persons in care.
(b) The licensee may use teacher aides in a teacher-child ratio of one teacher and one aide for every 15 children in attendance. (1) A ratio of one fully qualified teacher (as specified in Section 101216.1(c)) and one aide for every 18 children in attendance in a preschool program is allowed when the aide meets the qualifications specified in Section 101216.2(d). This requierement was not met as evidenced by: Based on LPA observations, interviews and records review Preschool #2 had 1 teacher and 2 assistants (no ECE units) with 16 children. This poses a potential risk to the health, safety, and personal rights of children in care.
Responsibility for Providing Care and Supervision — information obtained via an unusual incident report and witness statements for two children to conduct inappropriate touching. The lack of supervision made by a 5-foot wall that obstructed the staff’s line of sight This poses risk to the health, safety and or personal rights of children in care.
