Criminal background check — Based on LPAs observation and interviews, uncleared Staff #1 was observed at the facility at 12:40pm, and Director, Staff #2 and Staff #3 confirmed that the uncleared Staff #1 were presence and provided care for the children in care, which poses an immediate health, safety or personal rights risk to persons in care.

Teacher-Child Ratio — Based on LPAs observation and interviews, Staff #2 and Staff #3 were supervising 25 children in care, Director provided statement confirming facility was out of ratio while Director left the facility, which poses an immediate health, safety or personal rights risk to persons in care.

Criminal background check — Based on observation, interview, and record review, the licensee did not comply with the section cited above in 1 out of 1 staff. S4 has not received criminal record and child abuse index clearance and Director confirmed that S4 has been working at the facility for over 1 month - more than 16 hours a week, which poses an immediate health, safety or personal rights risk to persons in care.

Limitations on Capacity and Ambulatory Status — Based on observation, interview, record review, the licensee did not comply with the section cited above in 12 out of 12 infants in care. At 10:10am, as LPAs observed some children who appeared to be too young to be a preschooler in classroom #1 and classroom #2, LPAs asked Licensee/Director about the age of the children in care and Licensee/Director stated all of the children in care were 2 years of age and older. During children record's review, 12 of 12 reviewed children records, revealed these 12 children were enrolled at the facility before they were 24 months. LPAs verified the sign in/out sheets with Director, and Director admitted that there were currently 5 children who are still under 24 months attending the facility today. which poses an immediate health, safety or personal rights risk to persons in care.

Posting of License — Based on observation and interview, the licensee did not comply with the section cited above in 1 out of 1 regulation. At 10:00am, LPA observed the deficiency regarding facility license was not posted in the facility. LPA addressed with Director at 10:10am upon Director's arrival at the facility, Director confirmed that License was not being posted and immediately posted the License by the front entrance of the facility, which posed a potential health, safety or personal rights risk to persons in care.

Mandated reporter training — Based on observation, interview and record review, the licensee did not comply with the section cited above in 2 out of 5 staff members. Staff #2 and staff #5 did not have the current Mandated Reporter training for Child Care provider which poses a potential health, safety or personal rights risk to persons in care.

Personnel Records — Based on observation, interview, record review, the licensee did not comply with the section cited above in 1 out of 5 staff members. Staff #1 did not have a complete LIC 503 form inclduing missing information regarding TB test clearance date, which poses a potential health, safety or personal rights risk to persons in care.

Personnel Records — Based on observation, interview, and record review, the licensee did not comply with the section cited above in all of personnel record. Upone arrival, LPA reuested for the personnel records, but there was no personnel records at the facility, Director/Licensee arrived at the facility at approximately 10 minutes later and brought the personnel records to the facility. Director/Licensee stated she took the reords home to make updates on the files, which posed a potential health, safety or personal rights risk to persons in care.

Child's Medical Assessments — Based on observation, interview, and record review, the licensee did not comply with the section cited above in 7 out of 12 reviewed children's records. Child #3, Child #4, Child #5, Child #9, Child #10, Child #11 and Child #12 did not have Physician's Report on file, which posed a potential health, safety or personal rights risk to persons in care.

Child's Records — Based on observation, interview, record review, the licensee did not comply with the section cited above in 3 of 12 reviewed children's records, Child #3, Child #4 and Child #5 did not have any required LIC forms on file, which posed a potential health, safety or personal rights risk to persons in care.

Health-Related Services — Based on observation, interview, and record review, the licensee did not comply with the section cited above in 1 out of 1 child in care, Child #1's medication did not have child's name and date and medication was expired, which posed a potential health, safety or personal rights risk to persons in care.

Health-Related Services — Based on observation, interview, record review, the licensee did not comply with the section cited above in 1 out of 1 regulation, Director stated she did not have an Incidental Medical Service (IMS) plan for the facility, which posed a potential health, safety or personal rights risk to persons in care.

Food Service — Based on observation and interview, the licensee did not comply with the section cited above in 1 out of 1 pesticide container. While inspecting the facility kitchen, at 10:40am, LPA Tran observed an insect spray can being stored on a shelve behind staff's food items. LPA addressed the concern immediately with Director, and Director moved the hazardous item to the patio by the back exit of the facility. At 11am, S3 took the children to the playground, LPA Tran addressed concern with the Director that the insect pray is now in a location where it was accessible to the children. Director then locked the spray in the shed on the side of the patio, which posed a potential health, safety or personal rights risk to persons in care.
