Responsibility for Providing Care and Supervision — Based on record review and interview, there were at least 3 incidents where a child in care sustained a minor injury and no facility staff visually observed the child during the incident. This poses/posed an immediate health, safety, or personal rights risk to person in care.
Carbon monoxide detectors required — Based on observation and interview with the facility represetative Yahaira Martinez, the licensee did not comply with the section cited above in that they could not determine the location of the carbon monoxide detector for the LPA to test, which poses an immediate health, safety or personal rights risk to persons in care.
Criminal background check — Based on record review, the licensee did not comply with the section cited above in 1 out of 22 staff criminal clearances, which poses an immediate health, safety or personal rights risk to persons in care.

Buildings and Grounds — Based on observation, the licensee did not comply with the section cited above in that there were items with labels that stated to call poison control if ingested, including "lysol" spray, "off" bug spray, and "raid" bug poison. LPA observed these items stored out of the reach of children, but not stored behind a lock, which poses/posed a potential health, safety or personal rights risk to persons in care.
Mandated reporter training — Based on record review the licensee did not comply with the section cited above in that Staff 1 (S1), S2, & S5 did not have proof of updated Mandated Reporter Training, which poses/posed a potential health, safety or personal rights risk to persons in care.
Personnel Records — Based on record review: Staff 1 (S1), S2, & S3 did not have a signed LIC9052 form, S1 & S3 did not have LIC503 form available to review, and S2 did not have a signed LIC501 form available to review, which poses/posed a potential health, safety or personal rights risk to persons in care.
(b) The name of the child care center director, and any fully qualified teacher(s) designated to act in the child care center director's absence, shall be reported to the Department within 10 days of a change of child care center director or designee(s). Based on the interview and record review, the Licensee did not meet the above regulation which poses a potential Health, Safety & Personal Rights risk to the children in care. Upon arrival the LPAs were greeted by S7 who stated the Director on file no longer works at the facility. The current
Indoor Activity Space — Based on observation, the licensee did not comply with the section cited above, LPA observed the carpeted areas and rugs in the classrooms and throughout the facility to having staining of grim and dirt which poses a potential health, safety or personal rights risk to persons in care.
