(f) When the child care center director is absent from the center...(1) If the child care center director is absent for more than 30 consecutive calendar days, the substitute director shall meet the qualifications of a director. Based on Designee's interview, it was disclosed the acting director Kathy Ledoux has been absent from the CCC for over 30 consecutive days. Teacher Qualifications and Duties — At around 12:30 PM, LPAs observed S2 providing care and supervision to four (4) children in the outdoor yard. File review of S2 revealed S2 does not meet the education qualifications to be a fully qualified teacher or qualified teacher aide. This is an immediate risk to health, safety, and personal rights...

Criminal Record Clearance — Durng inspection, LPA Reyes reviewed the Roster report and it was found out that Mallorie Galvez was not on the list and has been working since 10/9/2023. This poses an immediate risk to health and safety of children in care.

All personnel shall be given on-the-job training in the areas listed below... Such training or experience shall be appropriate to the job assigned and shall be evidenced by safe and effective job performance. This requirement was not met as evidence: Actions taken by the staff at the CCC on 5/25/23 and 8/7/23 demonstrated, staff did not have the knowledge to safely and effectively met the needs of the children resulting in children's personal rights being violated. This is an immediate risk to the health, safety and personal rights of children in care.

For a violation that the department determines constitutes physical abuse or resulted in serious injury, as defined in Section 1596.8865, to a child, the civil penalty shall be assessed as follows: (B) Five thousand dollars ($5,000) for a facility licensed to care for 31 to 100, inclusive, children. On 8/3/23, child received a seriously bodily injury in the CCC that resulted in C1 being diagnosed with an acute fracture of distal radius and ulna which was 100% displaced. This is an immeidate risk to the health, safety and personal rights or children in care. — requirement not met

Conduct Inimical- Conduct which is inimical to the health, morals, welfare, or safety of either an individual in or receiving services from the facility or the people of this state. This requirement was not met as evidenced: interview of W1 which determined that the CCC provided misleading information to CCLD and the parent of C1 regarding incident which C1 exited the CCC without staff's knowledge. It was determined C1 was out of the CCC at least 20 minutes prior to C1 being found by staff. This is an immediate risk to the health, safety and personal rights of children in care.

(a)The licensee shall provide care and supervision as necessary to meet the children's needs. (1)No child(ren) shall be left without the supervision of a teacher at any time... Supervision shall include visual observation. This requirement was not met as evidenced: Based on interviews with CCC staff it was revealed C1 wandered out of the CCC for about 10 mintues without any CCC staff noticing C1 was missing. This is an immediate risk to the health, safety and personal rights to the children in care.

101226 -Health-Related Services (b) The licensee shall make prompt arrangements for obtaining medical treatment for any child if necessary. This is an immediate risk to the health, safety, and personal rights to the children in care. This requirement was not met as evidenced: C1 sustained injury on 8/3/23 at around 1600 and S1 did not obtain medical treatment for C1's injury until parents picked up C1 and took C1 to receive medical treatment. This is an immediate risk to the health, safety and personal rights of children in care.

Health-Related Services — Interview with Director revealed that Director found out about C1's injury through parent of C1. Director acknowledge not knowing of this incident as S1 did not report this injury to the Director. This is an immediate risk to the health, safety and personal rights to children in care.

Personnel Requirements — File review revealed that S1 did not have a required negative TB test within one year of being hired at the CCC. This is a potential risk to the health, safety and personal rights of children in care.

Personnel Requirements — File review revealed that S1, S2, and S3 did not have a Health Screening in their file for review during today's inspection. This is a potential risk to the health, safety and personal rights of children in care.

Staff immunization requirements — File review revealed S2 does not have proof of MMR vaccine on file and S4 does not have proof of influenza vaccine or influenza waiver on file for review during today's inspection. This is a potential risk to the health, safety, and personal rights of children in care.

Mandated reporter training — File review revealed S2 has only completed the general portion of the Mandated Reporter Training and S3 did not have any certificate on file for review. This is a potential risk to the health, safety, and personal rights of children in care.

Reporting Requirements — Interview with S2 revealed the acting Director is not present in the CCC. It was also revealed that the Director has been out of the CCC for about 3 weeks due to medical issues and this information was not reported to the Department. This is a potential risk to the health, safety and personal rights of

Mandated reporter training — During review of S1's file, it was noted that S1 has not taken the Mandated Reporter training. This poses a potential risk to health and safety of children in care.

Administrator Qualifications and Duties — During the inspection, since director was not present, S1 was appointed to be in charge, however, LPA did not observe the LIC 308, Designation of Responsibility disignating the teacher in charge, Deborah Sharer. This poses a potential risk to health and safety of children in care.

Staff immunization requirements — During file review,it was noted that S1 still lacks immunization records, marking the second instance of the same violation for the individual at the CCC, which is an indicatie that violation was never corrected. This poses a potential risk to health and safety of children in care.
