101223 Personal Rights (a)The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature.... This requirement was not met based on evidenced of records reviewed and interviews. LPA Rodriguez obtained information from corroborating interviews that revealed that staff do not adequately supervise pets in the facility resulting in a child being bitten, which posed an immediate risk to the health, safety and/or personal rights to children in care.

Drinking water lead testing — Based on interview and record review, the licensee did not comply with the section cited above, which poses a potential health, safety or personal rights risk to persons in care. Per licensee, the facility has not been tested for lead. Licensee stated that the children do not drink from the drinking fountains and only drink bottled water that they bring from home. Licensee did stated that she uses one of the sinks for boiling water when cooking.
Indoor Activity Space for School-Age Children — Based on observation. LPA observed 15 school age and 5 preschool children in the school age classroom. Which poses a potential health, safety or personal rights risk to persons in care.
Buildings and Grounds — LPA observed 14 cans of interior/exterior paint that was accessbile to children in care, which poses a potential health, safety or perosnal rights risk to persons in care.
Personnel Records — Based on record reveiw Staff #2 did not have a file at the facility for LPA to review. Which poses a potential health, safety or perosnal rights risk to persons in care.
