101229 Responsibility for Providing Care and Supervision(a)The licensee shall provide care and supervision as necessary to meet the children's needs. (1)No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. The facility did not comply with the section cited above during outdoor play LPA Chavies observed S1 leave playground leaving several children on an apparatus without supervision for about 2 minutes.
101223.2Discipline(a)Any form of discipline or punishment that violates a child's personal rights as specified in Section 101223 shall not be permitted regardless of authorized representative consent or authorization.The facility did not comply with the section cited above LPA observed C#1 and C#2 were engaging in a physical altercation and no staff member was watching. S#4 walks over and takes C#1 by the arm and walks him over to a sectioned off part of the classroom and makes C#1 sit there. S#4 stated, " No, you don't do that."

Administration of Child Care Licensing (3) On and after January 1, 2018,a person who becomes an administrator or employee of a licensed child day care facility shall complete the mandated reporter training ..... (a)within the first 90 days that he or she is employed at the facility and shall complete renewal mandated reporter.....Based on record review and interview, the license did not comply with the section cited above. Staff#6 did not have current mandated reporter training certificate which poses a potential Health, safety and Personal Rights
