All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing, or volunteering in a licensed facility: Obtain a California clearance or a criminal record exemption as required by the Department. Based on interviews and record review, the licensee did not comply with the section cited above in one out of one staff did not obtain a criminal record clearance which poses an immediate health, safety or personal rights risk to children in care.
Smoking is prohibited on the premises of a family child care home as specified in Health and Safety Code Section 1596.795(a). Based on interviews, the licensee did not comply with the section cited above as it was reported the licensee vaped on multiple occasions in front of daycare children which poses an immediate health, safety or personal rights risk to children in care.

(a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (2) To receive safe, healthful, and comfortable accommodations, furnishings, and equipment. Based on the licensee's statement that a child recently fell out of a high chair because they were not properly secured and LPA's observation of a child climbing a stack of chairs. This is an immediate health and safety risk to children in care.

Personal Rights — Based on interviews, the licensee did not comply with the section cited above in multiple children did not receive a diaper change when needed which poses a potential health, safety or personal rights risk to children in care.
As soon as possible but no later then the same business day, the licensee shall notify a child's parent or authorized representative regardless of the injuries or acts that affect that child as specified in Health and Safety Code Section 1597.467(a). Based on interviews and record review, the licensee did not comply with the section cited above in one out of one injury notification which poses a potential health, safety or personal rights risk to children in care.
Health and Safety Code Section 1596.866 provides in part: (b) A licensee of a large family day care home shall ensure that at least one person who has a current certificate in pediatric first aid and pediatric cardiopulmonary resuscitation shall be available at all times when children are present at the facility, or when children are off-site of the facility for facility activities.... Based on interview and record review, the licensee did not comply with the section cited above in that two staff members left alone with children did not have valid FA/CPR certification which poses a potential health, safety or personal rights risk to children in care.
