This evidence is not met by: Based on documentation, the department was informed of an altercation that took place between the Licensee and another individual at the facility during operating hours which poses an immediate health, safety or personal rights risk to persons in care.
Family home — home free of safety hazards — Based on observation, the licensee did not comply with the section cited above in that knives were observed on the counter in the kitchen that were accessible to children in care which poses an immediate health, safety or personal rights risk to persons in care.
Personal Rights — Based on observation, the licensee did not comply with the section cited above in that C1 was restrained in a baby jumper/baby bouncer for approximately one hour and half which poses an immediate health, safety or personal rights risk to persons in care.
(d) All individuals subject to a criminal record [...] shall prior to working [...] (2) Request a transfer of a criminal record clearance as specified in Section 102370(j). This evidence is not met by: Based on observation and interview, S1 had a Criminal Record Clearance but was not associated to the facility which poses an immediate health, safety or personal rights risk to persons in care.
Staffing Ratio and Capacity — Based on pertinent interviews and documentation obtained by the Department, it was determined that the facility has operated out of ratio several times. The investigation also revealed that the facility has operated with 9 children and 1 staff member.
Family home — children supervised at all times — Based on pertinent interviews and documentation obtained by the Department, it was determined that the Licensee does not reside in the home and was not present 80% of the time.

Family home — children supervised at all times — Based on observation, the licensee did not comply with the section cited above in that upon arrival, LPAs observed S1 and S2 in the facility while the Licensee was not present which poses/posed a potential health, safety or personal rights risk to persons in care.
Mandated reporter training — Based on interview and record review, the licensee did not comply with the section cited above in that S1 and S2 did not have proof of the Mandated Reporter Training Certificate which poses/posed a potential health, safety or personal rights risk to persons in care.
Personnel Records — Based on record review, the licensee did not comply with the section cited above in that S1 and S2 did not have personnel records present at the facility which poses/posed a potential health, safety or personal rights risk to persons in care.
Family home — admission procedures and parent rights — Based on observation, the licensee did not comply with the section cited above in that the PUB 394 (8/02), Family Child Care Home Notification of Parents' Rights Poster was not posted which poses/posed a potential health, safety or personal rights risk to persons in care.
Immunizations — Based on record review, the licensee did not comply with the section cited above in that C1 and C2 did not have proof of immunization record which poses/posed a potential health, safety or personal rights risk to persons in care.
Operation of a Family Child Care Home — Based on record review, the licensee did not comply with the section cited above in that C1 and C2 was missing the Affidavit Regarding Liability Insurance For Family Child Care Home form (LIC282) which poses/posed a potential health, safety or personal rights risk to persons in care.
Revocation or Suspension of a License or Registration — Based on record review, the licensee did not comply with the section cited above in that it was discovered the Licensee did not submit a Rental Agreement. LPA was not able to review current control of property during the inspection. Additionally, LPA reviewed the LIC9149 which was signed by an individual who is not listed as being the property owner per the San Bernardino County Recorders Office which poses a potential safety risk to persons in care.
Family home — preventive health training, including pediatric CPR and first aid — Based on record review, the licensee did not comply with the section cited above in count of 1 person which posed a potential health and safety risk to persons in care. Licensee's Assisant's (S1) CPR & 1st Aid Card expired on 03/2024. S1 was supervising children with no other adult present that had a current CPR & 1st Aid Card.
