Criminal record clearance transfer was not completed. All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing, or volunteering in a licensed facility: Request a transfer of a criminal record clearance as specified in Section 102370(j) This was not evidenced by: LPA conducting interviews with prior families and licensee acknowleding he did not associate his spouse.

Infant Safe Sleep — Based on the licensee did not comply with the section cited above in which poses a potential health, safety or personal rights risk to persons in care. LPA found that licensee stated it was their understanding they did not have to document infant sleep regulations beyond 18 months.

Family home — admission procedures and parent rights — Based on observation the licensee did not comply with the section cited above in which poses a potential health, safety or personal rights risk to persons in care. LPA did not observe the parent rights filled out for some children.
Licensee not present 80% of operating hours. The licensee shall be present in the home and shall ensure that children in care are supervised at all times. When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence. Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day. This was not evidenced by: LPA conducting interviews with prior families which confirmed licensee was not regularly present for 80% of operating hours.
The licensee shall report the following information the Department by telephone or fax within the Department's next business day and during normal working hours (8am to 5pm). This requirement is not met as evidenced: LPAs learned that police were called to assist with an incident that took place on July 15, 2024. This is a potential risk to the health and safety of children in care.
