101229(a)(1) The licensee shall provide care & supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time...and Supervision shall include visual observation. This regulation was not met as evidenced by: Based on LPA interview, record review and the licensee's own admission, the facility failed to provide care & supervision necessary when a child obtained an injury while in care unknown to the facility staff which is an immediate health & safety risk to to children in care.

(b) Center staff shall sign in a school-age child who arrives at the center on his/her own. — requirement not met

Buildings and Grounds — Based on observation, the director did not comply with the section cited above as director did not ensure poisons, including bottles of disinfectant solutions and sprays and a can of insecticide, were locked which poses a potential safety risk to children in care. The poisons were located in a cabinet with a magnetic latch that was not secured.

Teacher-Child Ratio — Based on interviews conducted and records reviewed, it was revealed that a staff member supervised 19 children alone for 30 minutes which poses a potential safety risk to children in care.

101212(f) Reporting Requirements (f) The items specified in (d)(1)(A) through (H) above shall also be reported to the child's authorized representative. This regulation was not met as evidenced by: Based on LPA interview, record review and by the licensee's own admission, the facility failed to report an incident where a child was injured to a child's authorized representative which is a potential risk to the health and safety of children in care.

Carbon monoxide detectors required — Based on observation the licensee did not comply with the section cited above in the facility has 2 inoperable smoke detectors in the indoor activity area, which poses a potential health, safety or personal rights risk to persons in care.

Staff immunization requirements — Based on interview and record review, the licensee did not comply with the section cited above in a supervising staff present and working with daycare children was unable to provide proof of immunizations against influenza, pertussis, and measles as required, which poses a potential health, safety or personal rights risk to persons in care.

Child Care Center Director Qualifications and Duties — Based on interview record review, the licensee did not comply with the section cited above in the licensee failed to ensure that at least 1 supervising staff presently substituting in place of the director and caring for children at the facility had proof 16 hours of health and safety training, necessary pursuant to Health and Safety Code Section 1596.866., which poses a potential health, safety or personal rights risk to persons in care.

Personnel Requirements — Based on interview record review, the licensee did not comply with the section cited above in the licensee failed to ensure that a subject staff member present and working with daycare children had proof of a test for tuberculosis, performed by or under the supervision of a physician not more than one year prior to or seven days after employment, which poses a potential health, safety or personal rights risk to persons in care.

Personnel Requirements — Based on interview and record review, the licensee did not comply with the section cited above in the facility did not ensure that a supervising staff present and caring for daycare children had a health-screening report LIC503 signed by the person performing the screening, which poses a potential health, safety or personal rights risk to persons in care.
