Personal Rights — Based on interviews, four out of four staff stated that they have heard or observed that while S4 was holding C1, and S2 attempted to grab C1 out of S4's arms. This poses an immediate health, safety or personal rights risk to persons in care.

Limitations on Capacity and Ambulatory Status — Based on interviews and record review, staff co-mingle infants with toddlers outside the conditions set forth in the facility waiver which poses an immediate health risk of the children in care.

Personal Rights — Based on interviews, Staff 4 (S4) confirmed an incident where they held Child 1 (C1) in an rough manner. S4 was written up. Authorized representatives of C1 observed the incident via video footage and reported to facility which poses an immediate personal rights risk to children in care.

This evidence has not been met by: Based on observation and interview: At 9:25AM, LPA Navar observed 1 staff member (S1) providing care for 5 infants in the Infant classroom. S1 stated they need to call for back up.

Responsibility for Providing Care and Supervision for Infants — Based on LPA’s staff interviews, two (2) staff members in Infant Room #3 did not observe an incident on 02/20/2024 involving C1 sustaining a bite on the right cheek by C2. The bite did not break skin but left a quarter size mark on C1. This poses an immediate health, safety or personal rights risks to persons in care.

Personal Rights — Based on LPA's interviews and record review, C1 had 10 incidents of biting total and facility did not follow biting policy to prevent injuries to other infants. This poses an immediate health, safety or personal rights to persons in care.

Mandated reporter training — Based on record review, the licensee did not comply with the section cited above. 2 out of 5 staff did not have a curernt mandated reporter certificate on file. This poses/posed a potential health, safety or personal rights risk to persons in care.

Infant Care Food Service — Based on record reviews, C1’s 05/09/2025 Daily Report showed no record of bottle being provided to C1, facility did not follow Needs and Services Plan’s bottle-feeding schedule: “6am and every three hours. Keep offering every 30 minutes until bottle empties”, which poses a potential health, safety or personal rights risk to persons in care.

Reporting Requirements — Based on interviews, Staff 4 (S4) confirmed an incident where they held Child 1 (C1) in an rough manner. The incident was not reported to the Department which poses a potential health and safety risk of children in care.

Infant Care Activities — Based on interviews, Staff 2 (S2) stated there is an infant that sleeps on the floor and staff do not go in the crib area because of ratios which poses a potential health and safety risk of children in care.

Assistant Infant Care Center Director Qualifications and Duties — Based on observation and interview, the licensee did not comply with the section cited above in that assistant director was not present when 25 or more infants were in care, which poses a potential health, safety or personal rights risk to persons in care.

Health-Related Services — Based on intervirew with staff, a child was bitten on the face and staff did not call front desk for assistance and instead waited 15 minutes to apply an ice pack to the child. This poses a potential health, safety or personal rights risks to persons in care.
