Responsibility for Providing Care and Supervision — Based on observation, the licensee did not comply with the section cited above. A child was observed, by the LPA, inside an empty classroom while staff were supervising children outside on the playground. This poses an immediate health, safety or personal rights risk to persons in care.

Criminal Record Clearance — Based on observation and record review, the licensee did not comply with the section cited above. Staff/Teacher Jenifer Barrios, was observed providing care and supervision to children however, based in record review, Criminal Record Clearance has not been associated to the facility. This poses an immediate health, safety or personal rights risk to persons in care. $500.00 civil penalty is being accessed with this citation.

Mandated reporter training — Based on record review, the licensee did not comply with the section cited above. In reviewing staff files, it was determined that Staff #3 had not renewed the required training. This poses/posed a potential health, safety or personal rights risk to persons in care.

Staff immunization requirements — Based on record review, the licensee did not comply with the section cited above. In reviewing staff files, it was determined that Staff #3 did not have proof of the required immunizations (MMR/Tdap/flu) on file for review. This poses/posed a potential health, safety or personal rights risk to persons in care.

Child Care Center Director Qualifications and Duties — Based on record review, the licensee did not comply with the section cited above. In reviewing staff files, it was determined that staff present did not have proof of completing a Health and Safety course. This poses/posed a potential health, safety or personal rights risk to persons in care.

Child's Medical Assessments — Based on record review, the licensee did not comply with the section cited above. In reviewing children files, it was determined that Child #6 did not have the required Physician Report on file for review. This poses/posed a potential health, safety or personal rights risk to persons in care.

Personal Rights — Based on record review, the licensee did not comply with the section cited above. In reviewing children files, it was determined that Child #5 did not have the required Personal Rights form signed by parent/legal guardian on file for review. This poses/posed a potential health, safety or personal rights risk to persons in care.

Drinking water lead testing — Based on record review, the licensee did not comply with the section cited above. The facility has yet to have there drinking water tested. This poses/posed a potential health, safety or personal rights risk to persons in care.

Mandated reporter training — Based on record review, the licensee did not comply with the section cited above. Staff completed the general portion and/or the portion for School Personnel, and not the training that complies with AB1207. This poses/posed a potential health, safety or personal rights risk to persons in care.

Personnel Requirements — Based on record review, the licensee did not comply with the section cited above. All CPR/1st aid cards/certificates reviewed were not EMSA certified. This poses/posed a potential health, safety or personal rights risk to persons in care.

Personal Rights — Based on record review, the licensee did not comply with the section cited above. In reviewing children files, Child #5, did not have the required LIC 613A form completed. This poses/posed a potential health, safety or personal rights risk to persons in care.
