Personal Rights — Based on observation, interviews, and record review, it was revealed that the staff #1 handled the child in a rough manner while in care which poses an immediate risk to the health and safety of children in care.

(b) (1)   On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement was not met by LPA's observation and records review, Staff #1. Does not have Mandated Reporter Training Exp: 5/28/25, which poses a potential health and safety or personal rights risk to persons in care.

Alterations to Existing Buildings or New Facilities — Based on observation and interview the facility made alterations to the ceiling without prior notification to the Licensing Department which posed a potential health, safety, or personal rights risk to the persons in care.

Fixtures, Furniture, Equipment and Supplies — Based on observation the school aged children were sitting in their area in the dark because the main lights were off due to preschool children napping. There were no other lighting options observed during the inspection which poses a potential health, safety, or personal rights risk to the persons in care.

101223(a)(2)(3)- Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful, and comfortable accommodations, furnishings, and equipment to meet his/her needs. (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature including but not limited to interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. Based on observation, interviews, and record review, it was revealed that the staff #1 spoke inappropriately to the child while in care which poses an potential risk to the health and safety of children in care.
