(a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance, except as specified in (b) and (c) below. Based on the record review and interview, the Licensee did not meet the above regulation which poses an immediate safety risk to the children in care. During interviews for a self-reported Unusual Incident Report, it was disclosed there were two children with 25 staff when an injury occurred.

Responsibility for Providing Care and Supervision — Based on the observation, the Licensee did not meet the above regulation which poses an immediate safety risk to the children in care. During the facility tour, the LPAs entered a classroom which had 14 children and two staff. One staff was standing by the front door with a small group of children and one staff was sitting in a chair behind a mounted cubby with small group of children. When the LPA approached the restroom, there were two children inside without supervision.

Criminal background check — Based on the observation and record review, the Licensee did not meet the above regulation which poses an immediate safety risk to the children in care. During the facility tour the LPAs observed S1 and S2 providing Care and Supervision to the children in care. Upon reviewing the facility association roster, it was discovered S1 has a Criminal Record Clearance but is not associated and S2 does not have a Criminal Record Clearance.

During interviews it was disclosed the facility operates out of ratio for periods ranging from 10-25 mins about three to five days a week. On the Child Supervision Records provided by the facility

Personal Rights — Based on the interview and record review, the Licensee did not meet the Personal Rights regulation which poses an immediate Health, Safety & Personal Rights risk to the children in care. There were at least 5-7 incidents documented involving a child being bitten and scratched by other children. The Director confirmed the indicidents reported did occur while in care.

Mandated reporter training — Based on the record review, the Licensee did not meet the above regulation which poses a potential health risk to the children in care. During the staff file review, the LPA was unable to review a current Mandated Reporter certificate for S3.

Staff immunization requirements — Based on the record review, the Licensee did not meet the above regulation which poses a potential health risk to the children in care. During the staff file review, the LPA was unable to review immunizations for S1, S2 and S5.

Personnel Requirements — Based on the record review, the Licensee did not meet the above regulation which poses a potential health risk to the children in care. During the staff file review, the LPA was unable to review an LIC 503 Health Screening for S2..

Personnel Records — Based on the record review, the Licensee did not meet the above regulation which poses a potential health risk to the children in care. During the staff file review, the LPA was unable to review a TB Clearance for S2.

Mandated reporter training — Based on the record review, the Licensee did not meet the above regulation which poses a potential Health risk to the children in care. During file review the LPA was unable to review a current Mandated Reporter for S1, S2, S3 and S4.

Health-Related Services — Based on the facility tour, the Licensee did not meet the above regulation which poses a potential Health risk to the children in care. During the review of medication the LPA observed medication for C1 not in the original container and without a label.
