101223 Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights:...(3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature... This regulation was not met as evidenced by: Interviews revealed that T1 had made inappropriate comments to children in care on several occastions. This poses an immediate health, safety, or personal rights risk to children in care.

Teacher Qualifications and Duties — Based on observation and file review, T1 was supervising children in care alone without obtaining the required teacher units.

101216.3 Teacher-Child Ratio...(b)The licensee may use teacher aides in a teacher-child ratio of one teacher and one aide for every 15 children...(1)A ratio of one fully qualified teacher...and one aide for every 18 children...when the aide meets the qualifications...This regulation was not met as evidenced by: Based on file review and interviews, T2, with no units, was assisting a fully qualified teacher with 18 children. T3, with no units, was assisting a fully qualified teacher with 16 children which poses an immediate health, safety, or personal rights risk to children in care.

Indoor Activity Space for School-Age Children — Based on observation and file review, the facility comingled preschool and school aged children which poses an immediate health, safety, or personal rights risk to children in care.

Reporting Requirements — LPA learned of an incident where T1 pulled a backpack off a child causing injury in 2/24 & was not reported to CCLD. This poses an potential health & safety risk to children in care.

Child Care Center Director Qualifications and Duties — Based on file review, the facility did not have a fully qualified substitute director which poses a potential health, safety, or personal rights risk to children in care.

Personnel Records — Based on file review, the facility did not have updated personnel files showing the required educational qualifications for staff which poses a potential health, safety, or personal rights risk to children in care.
