Criminal background check — Based on observation and record review, the Licensee did not meet the above regulation which poses an immediate safety risk to the children in care. During the facility tour the LPAs observed S1 and S2 providing Care and Supervision to children in care. Upon reviewing the facility association roster, it was discovered S2 has a Criminal Record Clearance but was not associated to the facility at the time LPAs arrived and S1 does not have a Criminal Record Clearance.

Responsibility for Providing Care and Supervision: (1)No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This was not met as evidenced by: Based on interviews conducted with pertinent parties, a child ran out of a classroom to another building, completely out of the entrance/exit door of the center. During this time, there was no staff present, resulting in an Absence of Supervision. This poses an immediate risk to persons in care.

Personal Rights (a)The licensee shall ensure that each child is accorded the following personal rights:(1) To be accorded dignity in his/her personal relationships with staff and other persons. This was not met as evidenced by: It was admitted that children's personal rights were violated. A former staff was “aggressively” grabbing children by their arms and sit them down. This is an immediate risk to the health and safety of children in care.

Teacher-Child Ratio — Based on observation, the Licensee did not meet the above regulation which poses/posed a potential health and safety risk to persons in care.

Fixtures, Furniture, Equipment and Supplies — Based on LPA's observation, one of the classrooms had the bottom border around the wall coming undone. The plastic piece has a sharp corner, which could be harmful to children in care. LPA observed toys near the plastic piece coming off of the wall. Additionally, the preschool playground had a big crack in the plastic climbing structure. This poses an immediate health, safety or personal rights risk to persons in care.

Buildings and Grounds — Based on LPA's observation, there was dirt, debris and stains on the carpet inside the classrooms where children play. A spot the size of a baby car seat was observed on one of the rugs, while other rugs had multiple stains. These stains were brownish-black in color. There was a restroom in the preschool classroom that has a soiled bag of trash on the floor, immediately to the right of the door. There was also poop smeared on the toilet paper dispenser, which had no toilet paper in it. No toilet paper was observed in 2 out of 4 of the children's restrooms. The tables and floors do not look like they have been wiped down and are sticky to the touch. The floor tile had multiple stains and droppings of unknown substances, leaving the floor with dried up drops. The igloos used for uncontaminated drinking water was observed in classrooms, but empty and with grime and dust on the top of them. This poses an immediate health, safety or personal rights risk to persons in care.

Health-Related Services — Based on record review, the licensee did not comply with the section cited above. There was no label or directions from physician for 2 out of the 2 children with medication on file at the facility. This poses an immediate health, safety or personal rights risk to persons in care.

Responsibility for Providing Care and Supervision — Based on observation, there were three instances where C1 unlocked the latch on the half wall in the preschool classroom and went into the school-age classroom while no school age children were present. The director was present with the LPAs in the school-age classroom. The second and third time, staff followed C1 immediately into the school-age classroom which poses a potential health, safety or personal rights risk to persons in care.

Reporting Requirements: Upon occurrence, during operation of the childcare center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day &during it's normal business hrs. In addition, a written report containing the info specified in (d)(2) below shall be submitted to the Department w/in 7 days following the occurrence of such event. (1) Events reported shall include the following: (C)Any unusual incident or child absence that — requirement not met

(d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the info specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. Sign In and Sign Out — Based on director interview and record review, facility did not have sign in/out sheets available for authorized representatives on 11/01/24 resulting in no signatures for sign in. This poses a potential health and safety risk to children in care.

Staff immunization requirements — Based on record review, the licensee did not comply with the section cited above. 1 out of 4 staff did not have proof of measles (MMR) on file. This poses/posed a potential health, safety or personal rights risk to persons in care.

Notice to parents that site visit reports are available — A licensed child care facility ...provide to the parents of each child... in the facility copies of any licensing report... any Type A citation... immediate risk to the health, safety, or personal rights of children in care This requirement was not met as evidenced by: Based on record review, the licensee did not comply with the section cited above in 6 out of 6 persons. This poses/posed a potential health, safety or personal rights risk to persons in care.

Drinking water lead testing — Based on record review and director's own admission, the facility did not comply with the section cited above. The facility has not gotten a water lead testing done. This poses/posed a potential health, safety or personal rights risk to persons in care.

Fixtures, Furniture, Equipment and Supplies — Based on observation, one of the trash cans did not have a lid that closed properly, leaving trash exposed to children in care. This poses/posed a potential health, safety or personal rights risk to persons in care.

Mandated reporter training — Based on record review, 2 out of 4 staff did not have their mandated reporter training updated, as needed. Both staff had expired mandated reporter training's on file. This poses/posed a potential health, safety or personal rights risk to persons in care.

Staff immunization requirements — Based on record review,1 out of 4 staff did not have any of their immunizations; no measles, no pertussis, no flu shot on file. This poses/posed a potential health, safety or personal rights risk to persons in care.
