Kindercare Learning Center

The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This regulation was not met as evidenced by: Based on the investigation interviews and record reviews, multiple biting, scratching and hitting incidents occurred at the facility between 08/2025 through 02/2026, which is an immediate risk to the health and safety of children in care.

(a) In addition to the sign-in procedure requirement of Section 101226.1(b), the licensee shall develop, maintain and implement a written procedure to sign the child in/out of the child care center that shall, at a minimum, include the following: (1) The person who signs the child in/out shall use his/her full legal signature and shall record the time of day. — requirement not met

(b) The person who brings the child to, and removes the child from, the center shall sign the child in/out. — requirement not met

101212(d) Reporting requirements…the child care center of any of the events specified in (d)(1)…a report shall be made to the Department by telephone or fax within the Department's next working day & during its normal business hours… as specified in (d)(2)…following the occurrence of such event. This regulation was not met as evidenced by: Based upon LPA record review and interview, by admission the facility director did not report an unusual incident occurring on 05/07/25, which is a potential health and safety risk to children in care.

Mandated reporter training — Based on records reviewed, the director did not comply with the section cited above as director did not ensure mandated reporter trainings were completed by the expiration dates for five out of seven staff present which poses a potential safety risk to children in care.

Staff immunization requirements — Based on records reviewed, the director did not comply with the section cited above as director did not ensure all required immunizations were maintained for three out of seven staff present which poses a potential health risk to children in care.

Personnel Requirements — Based on records reviewed, the director did not comply with the section cited above as director did not ensure Health Screening Report (LIC 503) forms, including a tuberculosis clearance, were completed and maintained for two out of seven staff present which poses a potential health risk to children in care.

Sign In and Sign Out — Based on record review, the director did not comply with the section cited above as director did not ensure 32 out of 53 children present were signed in which poses a potential safety risk to children in care.

Outdoor Activity Space — Based on observation and interview, the licensee did not comply with the section cited above in the LPA observed the blacktop surface to be raised and cracked by the growth of large tree roots, which is a potential tripping hazard. In addition, although the artificial rubber turf installed was observed to have some padding underneath that provided a bounce, the material was hard as a rock and rough to the touch due to the wear and tear, which poses a potential health, safety or personal rights risk to persons in care.

Mandated reporter training — Based on record review, the licensee did not comply with the section cited above in 3 staff member's present did not have proof of their mandated reporter training part 2 AB1207 Child Care Specific certificates, which poses a potential health, safety or personal rights

Staff immunization requirements — Based on record review, the licensee did not comply with the section cited above in 1 staff file did not have proof of the measles and pertussis vaccinations on file, nor did the staff have a medical exemption on file from a certified physician, which poses a potential health, safety or personal rights risk to persons in care.

Personnel Requirements — Based on record review, the licensee did not comply in the licensee failed to ensure that an opening and closing staff member participated in an EMSA approved CPR/1st Aid training for duties assigned to include the transportation of children to and from the facility, which poses a potential health, safety or personal rights risk to persons in care.
