The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This regulation was not met as evidenced by: Based on the investigation interviews and record reviews, multiple biting, scratching and hitting incidents occurred at the facility between 08/2025 through 02/2026, which is an immediate risk to the health and safety of children in care.

Criminal Record Clearance — Based on observation, interview conducted, and records reviewed, it was disclosed S1 has been working at the facility since 01/30/2024 without obtaining a criminal record clearance which poses an immediate safety risk to children in care. A civil penalty of $500 is being assessed and provided.

Personal Rights — Based on lnformation gathered from interviews the facility did not comply with the section cited above in that an infant was subjected to hair pulling by staff which posed an immediated health, safety or personal rights risk to persons in care.

(a) Prior to, or within 30 calendar days following the enrollment of a child, the licensee shall obtain a written medical assessment of the child. This medical assessment enables the licensee to assess whether the center can provide necessary health-related services to the child. — requirement not met

Sign In and Sign Out — In addition the LPA observed sign in/out sheets to have only times or initials recorded on the documentation for subject children, which poses a potential health, safety or personal rights risk to persons in care.

(C) Documentation shall be maintained in the infant’s file and be available to the Department for review. Documentation shall include the following: (3) Time of each 15-minute check — requirement not met

Reporting Requirements — Based upon LPA record review, the facility did not report an incident occurring on 05/29/25 until 06/06/25. This is a potential health and safety risk to children in care.

Responsibility for Providing Care and Supervision for Infants — Based on record review, the licensee did not comply with the section cited above in LPA observed 2 infants in care, who did not have infant safe sleep plans available for children and staff, which poses a potential health, safety or personal rights risk to persons in care.

Staff immunization requirements — Based on record review, the licensee did not comply with the section cited above in 3 of 4 staff files reviewed were missing proof of measles, Influenza, and 1 of 4 staff files reviewed did not proof of required immunizations MMR, Tdap and Influenza or letter to decline, which poses a potential health, safety or personal rights risk to persons in care.

Personnel Requirements — Based on record review, the licensee did not comply with the section cited above in opening, closing and administrative staff did not have proof of EMSA approved CPR/1st Aid training which poses a potential health, safety or personal rights risk to persons in care.

Personnel Requirements — Based on record review, the licensee did not comply with the section cited above in 2 of 4 staff files reviewed did not have proof of the LIC503 Health screening, which poses a potential health, safety or personal rights risk to persons in care.

Infant Care Teacher Qualifications and Duties — Based onrecord review, the licensee did not comply with the section cited above in 1 of 4 files reviewed did not have proof of verifiable transcripts of required units which poses a potential health, safety or personal rights risk to persons in care.

Mandated reporter training — Based on record review, the licensee did not comply with the section cited above in 2 of 4 staff files reviewed were missing proof of the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and/or the renewal mandated reporter training after two years following the date on which they completed the initial mandated reporter training. which poses a potential health, safety or personal rights risk to persons in care.

Infant Needs and Services Plan — Based on interview and record review, the licensee did not comply with the section cited above in 3 of 4 records reviewed, did not have needs and services plans completed and/or available for staff to reference while caring for infant and toddler aged children, which poses a potential health, safety or personal rights risk to persons in care.

Child's Medical Assessments — Based on record review, the licensee did not comply with the section cited above in 4 of 6 files reviewed did not have proof of the LIC701 Physician's report, which poses a potential health, safety or personal rights risk to persons in care.

Immunizations — Based on record review, the licensee did not comply with the section cited above in 4 of 6 children's files were missing proof of immunization records, for children present, which poses a potential health, safety or personal rights risk to persons in care.

Responsibility for Providing Care and Supervision for Infants — Based on observation, interview and record review, the licensee did not comply with the section cited above in 16 of 18 children present and in care, during nap time, did not have infant safe sleep logs completed and by admission, the director stated as a regular practice, they only maintain 15 minute sleep logs for chidlren under 12 months of age, which poses a potential health, safety or personal rights risk to persons in care.

Outdoor Activity Space — Based on observation and interview, the licensee did not comply with the section cited above in the artifical grass turf and rubber matting in the infant playground was observed to be deteriorating with visible cracks, hardened matting which has lost the protective factor of cushioning, significantly separated and/or raised from the surface blacktop throughout the perimeter of the material creating a tripping hazard, which poses a potential health, safety or personal rights risk to persons in care.
