Based on the information obtained during today's visit, it was determined that Title 22 Regulation section 101229(A)(1) (Responsibility for providing Care and Supervision) was violated. The Regulation states that no child(ren) shall be left without the supervision of a..... teacher at any time...Supervision shall include visual observation. It was determined that the subject child was inside the classroom by themselves for a brief period of time, defined as a matter of seconds. The way the child got back into the classroom is only based off of assumptions. — requirement not met

Staff-Infant Ratio — Based on pertinent interviews conducted and documentation reviewed, it was revealed that the facility operated out of ratio in the infant classroom for a limited amount of time. It was revealed that this incident occured during drop-off time in the morning.

101416.5 Staff-Infant Ratio (d) There shall be one teacher to every 12 sleeping infants provided the remaining staff necessary to meet the ratios specified in (b) above are immediately available at the center. This requirment is not met as evidenced by: Based on observation there were 7 sleeping infants and 5 awake infants with only 1 staff providing care. Of the 5 awake infants, 2 were seen off their cots directly next to the staff, while 3 were sitting up on their cots. This poses/posed an immediate helath, safety, and/or personal rights risk to persons in care.

Responsibility for Providing Care and Supervision — Based on interviews obtained, it was determined that the child was able to walk out of the Infant-Toddler's main gate, as it was left open by the gardener.

Responsibility for Providing Care and Supervision for Infants — During pertinent interviews, it was found that no staff was able to explain the cause of the bruising, which proves the reported allegation to be true.

Personal Rights — Based on the staff member's own admission and information disclosed by the witness it was stated that the staff member pushed a child, but not with malicious intent. It was stated that the intention was to redirect the child from climbing on another child.

Responsibility for Providing Care and Supervision for Infants — Pertinent interviews stated that teachers do observe these moments, but are not taking enough measures to prevent this behavior from continuing. Also, during today's visit, several children were observed to be climbing into subject the classroom's sink.

Buildings and Grounds — Based on observation and interview, the facility had debris on the floor of the infant classroom including food, dust, discolored marks on the floor, and dark or discolored marks on a significant portion of the walls in the infant’s reach. Infants were observed crawling on the floor and putting their hands and feet in their mouth. Based on this information this poses/posed an immediate health, safety, and/or personal rights risk to persons in care.
