Type A(5)

This requirement was not met by evidence obtained and interviews conducted during the investigation where multiple parties provided evidence of unhealthy practices at the facility. If no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home as specified in subsections (b) and (c). This requirement was not met by interviews conducted stating licensee would provide care for children at a large capacity mulitple times without assistants present. This poses an immediate risk to the Health, Safety or Personal Rights to children in care.
(a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (2) To receive safe, healthful, and comfortable accommodations, furnishings, and equipment. The requirement was not met as evidenced by LPA observing a video where an infant was sleeping on a stroller while being covered by a blanket. Infant was not accommodated with safe sleeping furnishings.
(b) Cribs or play yards shall be free from all loose articles and objects The requirement was not met as evidenced by LPA observing a video where infants were sleeping in play yards with blankets in the play yard. Play yard should have been free of loose articles and/or objects.
Staffing Ratio and Capacity — Based on observation and record review, the licensee did not comply with the section cited above. LPA observed six preschool children and six infants including two under one year old. Licensee is operation out of ratio which poses an immediate health, safety or personal rights risk to persons in care.

Family home — home free of safety hazards — Based on observation, the licensee did not comply with the section cited above. LPA observed the emergency exit in the back yard is obstructed by a mesh fence which poses/posed a potential health, safety or personal rights risk to persons in care.
Staff immunization — influenza, pertussis and measles — Based on interview, the licensee did not comply with the section cited above. Licensee's husband did not have immunization records on file which poses/posed a potential health, safety or personal rights risk to persons in care.
Family home — home free of safety hazards — Based on record review, the licensee did not comply with the section cited above. Child 10 is missing LIC627 which poses/posed a potential health, safety or personal rights risk to persons in care.
