Responsibility for Providing Care and Supervision for Infants — ; On December 29, 2025 the CCC self-reported that an infant was left alone, without supervision, outside of the classroom for approximately two minutes, which poses/posed an immediate health, safety or personal rights risk to persons in care.

Reporting Requirements — ; Based on observation, interview and record review, the Licensee did not comply with the section cited above as they did not reports the closure reasons of the kitchen and infant classroom to the to children’s authorized representatives, which poses/posed a potential health, safety or personal rights risk to persons in care.

Personal Rights — ; Based on interviews, evidence collected and records reviewed, the licensee did not comply with the section cited above where it was found that the allegation Staff handle children in a rough manner is Substantiated, Which poses a potential health, safety or personal rights risk to persons in care.

Personal Rights — ; Based on interviews, evidence collected and records reviewed, the licensee did not comply with the section cited above where it was found that the allegation Staff did not prevent a day-care child from sustaining injuries while in care, is Substantiated, Which poses a potential health, safety or personal rights risk to persons in care.

1596.817 Site visits; posting of notices; contents; citations for violations; duration of posting; civil penalties.. (b)(1) The notice posted pursuant to subdivision (a) shall remain posted for 30 consecutive days, except that a family day care home shall comply with the posting requirements contained in this subdivision only during the hours when clients are present. This was not met as evidenced by: During the visit om 10/3/25 LPA Gerth observed that the Notice of Site Visit was not posted from 9/4/25 last visit date, which poses/posed a potential health, safety or personal rights risk to persons in care.

Infant Care Center Fixtures, Furniture, Equipment, and Supplies — Based on observation the licensee did not comply with the section cited above where the infant children’s nap mats were not stored in a safe and sanitary manner and were found to be stored on top of a toilet and at the base of the toilet, which poses/posed a potential health, safety or personal rights risk to persons in care.

Buildings and Grounds — Based on observation the licensee did not comply with the section cited above in 2/2 bathrooms were not in good repair/proper working condition, which poses/posed a potential health, safety or personal rights risk to persons in care.

Outdoor Activity Space — Based on observation the licensee did not comply with the section cited above in LPA observed a large amount of foliage overgrowth which was encroaching over the fence and onto the infant playground and protruding screw(s) and plastic building materials were observed inside the infant playground on flooring next to the chain link fence enclosing a portion of the infant playground which poses/posed a potential health, safety or personal rights risk to persons in care.

Health-Related Services — Based on observation, interview and record review, the licensee did not comply with the section cited above where C1 did not have a complete file for prescribed medication on site, which poses/posed a potential health, safety or personal rights risk to persons in care.

Infant Care Food Service — Based on observation and interview the licensee did not comply with the section cited above in 3 or more infant food items were not properly labeled, dated or sealed, which poses/posed a potential health, safety or personal rights risk to persons in care.

101430(a)(3)(C) (a)Notwithstanding Section 101230, the following shall apply (3) The medical exemption shall be included in the infant’s file and be maintained as specified in Section 101221(d). (C) An infant shall not be swaddled while in care. This requirment was not met as evidenced by; Based on observation, interview and record review, the licensee did not comply with the section cited above in 1/1 infants observed by LPA to be utilizing a a sleep sack when awaking from napping in a crib at 10:44am. Although not swaddled, sleep sac still restricted infant movement, which poses a potential health, safety or personal rights risk to persons in care.

Buildings and Grounds — Based on observation and interview, the licensee did not comply with the section cited above where the licensee did not ensure that the infant indoor space is in good repair at all times, including proper functioning lights during operating hours/when children are in care, which poses/posed a potential health, safety or personal rights risk to persons in care.

Indoor Activity Space for Infants — Based on observation and interview, LPA did not observe a variety of age-approriate toys and equipment in Infant Room 1 therefore, the licensee did not comply with the section cited above in which poses a potential health, safety or personal rights risk to persons in care.

Outdoor Activity Space — Based on observation, the cinder block wall surrounding the infant play area is peeling and chipping in serveral areas accessible to children, therefore, the licensee did not comply with the section cited above which poses a potential health, safety or personal rights risk to persons in care.
