Personal Rights — Based on interviews conducted by LPA and a thorough review of facility records, it has been determined that the licensee failed to comply with the regulation cited above, as detailed in LIC 9099, which poses an immediatl risk to the health, safety, or personal rights to children in care.

(a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a interference with functions of ..... This requirement was not met by: Based upon LPA observations, and information gathered through interviews. Staff #1 was obsereved handling and yelling at day care children in a rough manner.

Care and Supervision. No child(ren) shall be left without the supervision, including visual observation, of a teacher at any time except as specified in sections 101216.2(e)(1) and 101230(c)(1). This regulation was not met by On November 8, 2024, child 1 was left outside unsupervised for less than one minute during a transition from the outdoor play yard to the classroom. This posed an immediate risk to the health, safety, and personal rights of the child in care.

Personal Rights — Based on interviews, the facility did not ensure that Child 1’s personal rights were protected. Although staff maintained visual supervision, Child 1 was isolated from the group, which poses a potential risk to the health, safety, or personal rights to children in care.

Responsibility for Providing Care and Supervision — Based on interviews conducted by LPA and a thorough review of facility records, it has been determined that the licensee failed to comply with the regulation cited above, as detailed in LIC 9099, which poses a potential risk to the health, safety, or personal rights to children in care.

Health-Related Services — Based on interviews and records reviewed, Licensee did not comply with the cited regulation, Staff did not follow physician's orders for child, which poses a potential risk to the health, safety, or personal rights to children in care.

Criminal background check — Based on interview and records reviewed, as of 12/17/2025, per Guardian Background Check System Staff 1, Staff 2 and Staff 3 were fingerprint cleared, but were not associated to this facility, which poses a potential health, safety or personal rights risk to persons in care.

A licensed child day care facility shall provide to the parents or guardians of each child receiving services in the facility copies of any licensing report that documents any Type A citation ... (1) of subdivision (a) of Section 1596.893b. — Based on file review and interview, 5 of 13 enrolled children files were missing the LIC9224, which poses a potential risk to the health, safety, or personal rights of children in care.

Application for License — Based on record review, licensee did not comply with the section cited above, licensee did not submit the need items to complete the application for Building 2. Which poses a potential health, safety, or personal rights risk to persons in care.

Reporting Requirements — Based on record review the facility did not notify the Department of incident that occurred on 12/23/2024 which poses a potential Health and Safety Risk to persons in care.

Teacher Qualifications and Duties — Based on record review, the licensee did not comply with the section cited above. Staff #1 has completed 9 of the 12 required childhood education units. This poses a potential health, safety or personal rights risk to persons in care. This poses a potential risk to the health, safety, or personal rights of children in care.
