Civil penalty in addition to suspension or revocation — Based on record review and interviews conducted today, it was determined a child walked away from the park and was found down the street unsupervised by staff, which poses an immediate health, safety or personal rights risk to persons in care.

Mandated reporter training — Based on observation and record review, director had an expired Mandated Reporter certification. T1 also did not have a completed Mandated Reporter certificate available for review. This poses a potential health, safety or personal rights risk to children in care.

Pediatric health and safety training (CPR/first aid) — Based on observation and record review, director was the only staff member who had a current CPR/First aid certificate on site. During LPAs’ visit, director left facility for approximately one hour, leaving 12 preschool children with T1, T2, T3, and licensee, who did not have a CPR/First aid certificate available for review. This poses a potential health, safety or personal rights risk to children in care.

Personnel Requirements — Based on observation and record review, T1 does not have a completed health screening report (LIC503) that is signed by a physician. This poses a potential health, safety or personal rights risk to children in care.

Transportation — Based on observation and record review, the child passenger restraint poster (PUB269) is posted in facility, however, is not complete with local health department information. This poses a potential health, safety or personal rights risk to children in care.

Teacher-Child Ratio — Based on observation and record review, director left facility for approximately 1 hour leaving T1, T2 and licensee present with 12 preschool children. T1, T2 and licensee did not have completed ECE units in their staff files for LPAs to determine T1, T2 and licensee are qualified teachers. This poses a potential health, safety or personal rights risk to children in care.

General — Based on observation, interview and record review, terms and conditions of open space waiver that was hand delivered to and discussed with director on December 5, 2024 were not followed. Conditions 8, 10, 17, 21 and 22 were not followed during LPAs’ visit on this date. This poses a potential health, safety or personal rights risk to children in care.

Disaster and Mass Casualty Plan — Based on observation, interview, and record review, the licensee did not comply with the section cited above. Director stated an emergency disaster drill has not been conducted since last year, which poses a potential health, safety or personal rights risk to persons in care.

Child's Medical Assessments — Based on observation, interview, and record review, the licensee did not comply with the section cited above in 6 out of 6 children's files did not have LIC701 Physician's reports completed, which poses/posed a potential health, safety or personal rights risk to persons in care.

Personal Rights — Based on observation, interview and record review, the licensee did not comply with the section cited above in 6 out of 6 children's files did not have LIC613A Personal rights completed, which poses/posed a potential health, safety or personal rights risk to persons in care.

Buildings and Grounds — Based on observation and interview, LPAs observed an accessible cleaning solution and an accessible, portable hot plate in kitchen, while kitchen door remained open. This poses a potential health and safety risk to children in care.

Personnel Records — Based on observation, interview and record review, LPAs did not observe a complete personnel record for any staff present. This poses a potential health and safety risk to children in care.

Personal Rights 101223(a)(3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirment was not met as evidenced by: Based on evidence collected, LPA determine allegation of staff gated food from day-care children is valid. This poses a potental health and safety risk to children in care.

Personal Rights — At 12:45PM., Based on observations and interview, LPA confirm child (C9) placed inside napping play pen during scheduled lunch time. This poses a potential health and safety risk to children in care.

Child Care Center Director Qualifications and Duties — At 1:25PM., Based on record review and interviews, LPA confirmed facility does not have a site director. This poses a potential health and safety risk to children in care.

Written directives for drinking water lead testing — At 1:30PM., Based on record review and interview, LPA confirmed facility fixtures, used for drinking water and food preparation, have not been tested for lead exceedance levels. This poses a potential health and safety risk to children in care.

Personnel Records — At 1:50PM., Based on record review, interview and observations, LPA confirmed present staff member’s file (S1) missing from facility records. This poses a potential health and safety risk to children in care.

101229(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation.
