Personal Rights — it was determined that Staff #1 engaged in inappropriate physical contact toward two children (child #1 and #2) resulting in minor injuries. These incidents pose an immediate risk to the health, safety, or personal rights to children in care in that inapproprioate physical contact was demonstrated and used by staff #1 to child #1 and child #2..
Personal Rights — Staff #1 yelled at Child #2 while attempting to enforce a time-out, repeatedly raising her voice and demanding that the child sit down. Staff #1 was also observed yelling at children on multiple occasions which poses an immediate risk to the health, safety, or personal rights to children in care.
Responsibility for Providing Care and Supervision — Staff #1 and Staff #2 observed Child #1 and Child #2 rough housing in the classroom. Despite being instructed to stop, the children continued to engage in physical fighting in which staff neglected to intervene which resulted in child #1 sustaining minor physical injuries in the facial area. This is an immediate safety risk to children in care.
Personal Rights — It is determined that chairs are used not as tools for regulation or redirection, but rather to threaten, demean, label and physically punish children for exhibiting maladaptive behaviors. This poses an immediate risk to the health, safety and/or personal rights of children in care in that the use of “time-out” is to be used appropriately in accordance to the dignity of children in care.
