101223 Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights:(2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. Which was not met as evidenced by: Based on LPAs interviews and observations, C1 and C2 climbed 2' high x 4' wide bookshelves repeatedly and incurred 2-3 injuries which poses a potential risk to the health, safety, and personal rights of persons in care.
(a)The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This was not met as evidenced by: Based on LPA interviews with staff members S1 and S3, it is corroborated that D1 required C1 to stand with their hands behind their back as a form of discipline which poses a potential risk to the health, safety, and personal rights of persons in care.
(a)The licensee shall ensure that each child is accorded the following personal rights: (1) To be accorded dignity in his/her personal relationships with staff and other persons. This was not met at evidenced by: D1 acknowledged she yells and interviews with staff corrobrorated that staff yell which poses a potential risk to the health, safety, and personal rights of persons in care.

This poses a potential health and safety risk to children in care. This is a repeat citation resulting in civil penalty $250. ***This is an amended report***
Teacher-Child Ratio The licensee may use teacher aides in a teacher-child ratio of one teacher and one aide for every 15 children in attendance. This was not met as evidence by. . . . . . based on interviews conducted and evidence recived the staff operated out of ratio on one or more occasions. This poses a potential health and safty risk to children in care.
Buildings and Grounds (a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. This was not met as evidence by. . . . . .based on interviews conducted and observations made the center did not ensure the outdoor play area was free of wasps and the metal mesh fence was repaired. This causes a potential health and safety risks to children in care.
Mandated reporter training — Based on interview, and record review, three staff members were missing AB 1207. The center did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care.
Sign In and Sign Out — Based on interview and record review, For the month of March 2024, there were over 10 children who were not signed in and/or out on more than one date, by the person who brought and/or took the child from the center. The licensee did not comply with the section cited above which poses a potential health, safety or personal rights risk to persons in care.

This was not met as evidence by. . . Based on interviews one or more staff members used loud, stern voices at the whole class and/or at an individual child in an aggressive manner. This poses a potential health and safety risk to children in care.
Upon the occurrence,. . .of any of the events specified in (d)(1) below, a report shall be made to the Department. . . this was not met as evidence by. . . Based on records reviewed there were four or more incidents that occurred that were not reported to the department. This poses a potential health or safety risk to children in care.
