Responsibility for Providing Care and Supervision — Based on LPA observation, D1 did not comply with the section cited above when 8 children and D1 were in an enclosed playyard. C6 opened the gate by themself, ran to a secondary gate (which lead to a side street) then exited by themself. After gathering the remaining 7 children, which took a few seconds, D1 was able to run after C6 with the remaining 7 children in tow. LPA observed C6 on the otherside of the street with D1 trying to cox him back to the facility side of the street. A few minutes passed until C6 willingly rejoined the group. No cars were observed to pass through. This poses a potential health, safety or personal rights risk to persons in care.
Limitations on Capacity and Ambulatory Status — Based on observation, the licensee did not comply with the section cited above when 8 of 8 preschool children were commingling with school age children in the schools playground (the picnic benches and grassy area, not the play structure) from approximately 11:30pm to 12:30pm which poses/posed a potential health, safety or personal rights risk to persons in care.
