(a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (1)To be treated with dignity in his/her personal relationship with staff and other persons. This was not met as evidenced by: A daycare child was left in the restroom for approximately 20 minutes, and was heard crying for majority of the time.
Mandated reporter training — Based on observation, interview conducted, and records reviewed, the licensee did not comply with the section cited above as licensee did not ensure mandated reporter training was completed for all staff by the expiration date which poses a potential safety risk to children in care.
Family home — preventive health training, including pediatric CPR and first aid — Based on observation, interview conducted, and records reviewed, the licensee did not comply with the section cited above as licensee did not ensure pediatric CPR and first aid certifications for all personnel were approved by EMSA which poses a potential safety risk to children in care.
Staff immunization — influenza, pertussis and measles — Based on observation, interview conducted, and records reviewed, the licensee did not comply with the section cited above as licensee did not ensure required immunizations were maintained for all personnel which poses a potential health risk to children in care.
