- 101161 Limitations on Capacity (a) A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. Based on the record review and interview, the Licensee did not meet the above regulation which poses an immediate Health, Safety & Personal Rights risk to the children in care. During the investigation, the Department received a sufficient amount of evidence to determine the facility has violated the two regulations.

101239 Fixtures, Furniture, Equipment and Supplies (a) A comfortable temperature for children shall be maintained at all times. Based on the record review/interview/observation, the Licensee did not meet the above regulation which poses an immediate Health, Safety & Personal Rights risk to the children in care. (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. Based on the interviews, the Licensee did not meet the above regulation which poses an immediate Health & Safety Rights risk to the children in care. During interviews with Pertinent Parties it was disclosed children who use the outdoor restrooms while on the playground, go in and close the door behind

Buildings and Grounds — Based on observation the licensee did not comply with the section cited above in LPA observed, bleach bottles, bleach wipes, toilet and floor cleaners, air freshners stored in unlocked lower classroom cabinets and upper classroom which poses an immediate health, safety or personal rights risk to persons in care.

Health-Related Services — Based on the record review, observation and interview, the Licensee did not meet the above regulation which poses an immediate Health, Safety & Personal Rights risk to the children in care. During the facility tour the LPA observed expired medications for C6. Per the Directors statement, C6 still attends the child care. C6 was present during inspection.

Indoor activity space for infants shall be physically separate from space used by children in the child care center and school-age child care center components. Based on the record review and the interview, the Licensee did not meet the above regulation which poses a potential Health, Safety & Personal Rights risk to the children in care. It was disclosed at the time the A/C stopped working properly the preschool children were moved to an infant classroom without prior authorization.

Health-Related Services — Based on the observation, the Licensee did not meet the above regulation which poses a potential health risk to the children in care. During the facility tour the LPA observed expired medication for a child who is no longer enrolled.

Mandated reporter training — Based on the record review, the Licensee did not meet the above regulation which poses a potential Health and Safety risk to the children in care. During the staff file review the LPA was unable to review a current Mandated Reporter certificate for S1 and S2.

Food Service — Based on the observation, the Licensee did not meet the above regulation which poses a potential health risk to the children in care. During the facility tour the LPA observed cleaning chemicals stored with food and paper goods used by children. All items were stored in cans, boxes or bags.

Buildings and Grounds — Based on the observation, the Licensee did not meet the above regulation which poses a potential health risk to the children in care. During the facility tour the LPA observed cleaning supplies in the classroom lower cabinets that were accessible to children in care. At the time of the tour the children were outside on the playground making the risk a potential.

Carbon monoxide detectors required — Based on observation the licensee did not comply with the section cited above in the licensee was unable to provide proof of a smoke alarms or carbon monoxide detectors in the children's classrooms, which poses a potential health, safety or personal rights risk to persons in care.

Fixtures, Furniture, Equipment and Supplies — Based on observation, the licensee did not comply with the section cited above in the LPA observed one child toilet leaking water onto the floor, surrounding the toilet which poses a potential health, safety or personal rights risk to persons in care.

Mandated reporter training — Based on record review, the licensee did not comply with the section cited above in 2 staff were missing proof of renewed Mandated reporter training certificates which poses a potential health, safety or personal rights risk to persons in care.

Staff immunization requirements — Based on record review, the licensee did not comply with the section cited above in 2 staff members were missing proof of immunization records which poses a potential health, safety or personal rights risk to persons in care.

Personnel Requirements — Based on record review, the licensee did not comply with the section cited above in 1 staff is missing the TB screening which poses a potential health, safety or personal rights risk to persons in care.

Personnel Requirements — Based on record review, the licensee did not comply with the section cited above in 2 staff were missing LIC501 Health screenings which poses a potential health, safety or personal rights risk to persons in care.

Child's Medical Assessments — Based on record review, the licensee did not comply with the section cited above in 3 children were missing proof of Physician's reports which poses a potential health, safety or personal rights risk to persons in care.

Immunizations — Based on record review, the licensee did not comply with the section cited above in 2 children were missing proof of immunization records which poses a potential health, safety or personal rights risk to persons in care.

All child care centers shall have working telephone service on the premises. Based on the interview, the Licensee did not meet the above regulation which poses a potential safety risk to the children in care. During interviews it was disclosed the facility’s phone has not been working for a week.

(d) When the director of an infant care center or the director of a combination center is temporarily away from the center, the director has the authority to delegate his/her responsibilities as specified below: (3) If the absence is more that 30 days consecutive calendar days, the substitute director shall meet the qualifications of a director. Based on the interview, the Licensee did not meet the above regulation which poses a potential Health, Safety & Personal Rights risk to the children in care. It was disclosed S1 did not complete the Preschool

Based on the interview, the Licensee did not meet the above regulation which poses a potential Health, Safety & Personal Rights risk to the children in care. Disaster and Mass Casualty Plan — Based on the record review, the Licensee did not meet the above regulation which poses a potential Health, Safety & Personal Rights risk to the children in care. During record review LPA reviewed an Emergency Drill Log dated 2022-2023. The last documented fire drill was conducted 6/23.

Health-Related Services — Based on the observation and interview, the Licensee did not meet the above regulation which poses a potential Health, Safety & Personal Rights risk to the children in care. During the facility tour the LPA observed expired medications for children who were no longer enrolled.

Mandated reporter training — Based on the record review, the Licensee did not meet the above regulation which poses a potential Health, Safety & Personal Rights risk to the children in care. During the file review LPA observed expired Mandated Reporter certificates for S1, S3 and S4.

Staff immunization requirements — Based on the record review, the Licensee did not meet the above regulation which poses a potential Health, Safety & Personal Rights risk to the children in care. During the file review LPA was unable to review a TB clearance for S3.

Food Service — (22) Equipment necessary for the storage, preparation and service of food or snacks shall be provided, and shall be well-maintained. Necessary equipment shall include, but not be limited to: (B) Hot and cold running water. Based on the observation and interview, the Licensee did not meet the above regulation which poses a potential Health, Safety & Personal Rights risk to the children in care. During facility tour the LPA tested the water and discovered the kitchen where dishes are washed and food is prepared did not have hot running water. Director stated they do not have hot water in the facility.
