101227 Food Services (a) In child care centers providing meals to children, the following shall apply: (7) Modified diets prescribed by a child's physician as a medical necessity shall be provided. (B) A child shall not be served any food to which the child's record indicates he/she has an allergy. Based on the interview and records review, the center did not comply with the section cited above. Specifically, dairy products were given to child C1 by mistake, despite the family previously disclosing to the center upon admission that C1 should not have dairy products. This situation presents an immediate health safety risk to the children in care.

Personal Rights — Based on the interview and records review, the center did not comply with the regulations cited above. The staff failed to promptly address the child's needs, resulting in the child crying for an extended period before receiving assistance. This violation poses a potential health and safety risk to the children in care.

Parent right of entry — Based on the interview and records review, the Center didn't adhere to the health and safety code cited above. The facility removed the child from its care after receiving a complaint and learning that the family had been in contact with the Licensing Office. This violation poses a potential health and safety risk to the children in care.

Reporting Requirements — Based on the interview and record review, the center is not in compliance with the above regulation. The center failed to promptly report an injury incident to the Licensing department. This violation potentially poses a health and safety risk to children in care.

101223 Personal Rights(a)The licensee shall ensure that each child is accorded the following personal rights:(2)To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. Based on the interview and records review, it was found that the center did not comply with regulations regarding providing reasonable and comfortable accommodations to children. The staff did not ensure that the children were provided with adequate clothing for the chilly outdoor conditions. This violation poses a potential health and safety risk to the children in care.

Infant Care Activities — Based on observation an infant sleeping in the cribs on tummy with sleep sack., the licensee did not comply with the infant sleeping regulation, which poses/posed a potential health, safety or personal rights risk to persons in care.

Mandated reporter training — Based on the record review, the Center did not comply with the abovementioned section. Five out of Seven staff members have not completed their Mandated reporter training, or the training has expired, which poses/posed a potential health, safety, or personal rights risk to persons in care.

§1596.956 Child day care centers serving infants; optional toddler program; departmental guidelines and regulations (a) The department shall develop guidelines and procedures to authorize licensed child daycare centers serving infants to create a special program component for children between 18 months to three years of age. The optional toddler program shall be subject to the following basic conditions: (5) The maximum group size, with two teachers, or one fully qualified teacher and one aide, shall not exceed 12 toddlers. — Based on observation, it was found that the Center did not comply with the regulations related to the toddler component. A toddler group size consisting of two teachers should not exceed 12 toddlers. However, the LPAs observed that there were sixteen toddler children present in the toddler classroom, and there was no partition to separate the two toddler groups. This poses/posed a potential health and safety risk to the children in care.
