Health-Related Services — Based on observations, interview and record review, the licensee did not comply with the section cited above in 3 out of 3 childrens files did not have IMS plan as well as 2 out of 3 children's files had expired medication which poses an immidiate risk to the health ans safety of the children in care.
Personal Rights — Interviews were conducted with Staff 1 (S1) to Staff 5 (S5). Of the 5 Staff interviewed, 2 Staff members were able to corroborate the allegation indicating they witnessed Staff 6 pull the arm of a child in a rough manner while in the outdoor play area.
Responsibility for Providing Care and Supervision — Interviews were conducted with Staff 1 (S1) to Staff 5 (S5). Of the 5 Staff interviewed, 1 Staff member was able to corroborate the allegation indicating that they witnessed a Staff member not providing supervision to a child which led to a fall. LPA reviewed facility report (date 11/22) which documented the fall and that ice was applied to the injured area.
Responsibility for Providing Care and Supervision — Per Staff 2, Child 2 was told to gather their belonging in preparation for leaving the facility for the day. Child 2 proceeded to walk to obtain their personal belongings alone. Staff 5 encountered and witnessed Child 2 alone while gathering their belongings.

Personal Rights — Staff #14 placed hands on children face to redirect the children which poses a potential risk to the health and safety of the children in care.
Food Service — Based on interviews , the licensee did not comply with the section cited above in that interviews disclosed a fly problem, flies have been observed to land on food and milk was not kept cool which poses/posed a potential health, safety or personal rights risk to persons in care.
Activities/Napping — Based on interviews , the licensee did not comply with the section cited above in that interviews disclosed staff being out of ratio during nap time, which poses/posed a potential health, safety or personal rights risk to persons in care.
