Personal Rights (a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (2) To receive safe, healthful, and comfortable accommodations, furnishings, and equipment. This was not met as evidenced by: Based on Licensee's statement and records obtained, confirming she sent C2 home with wet clothing, due to not having clean clothing at the facility for C2. This posed an immediate health, safety and personal rights risk to that child in care.
Infant Safe Sleep — **This is an Amended document** Based on photograph obtained, one year old Child 1 (C1) was in a pack-n-play at the facility with a pillow and blankets and vomit on their chin, shirt, vest and hands. On 6/28/24 LPA's observed, two pack-n-plays that had either blankets or pillows or both. This posed an immediate health, safety and personal rights risk to that child in care.

Civil penalty for failure to correct a violation — Based on interviews, record review and the licensee’s statement, on 3/15/23 the licensee did not prevent Child 1 (C1) from leaving the facility. C1 was without supervision for at least 10 minutes. This poses an immediate risk to the Health and Safety of children in care.
Civil penalty for failure to correct a violation — Based on LPA Yang’s observation and photographs taken on 3/23/2023 of a wine barrel partially filled with water. This poses an immediate risk to the Health and Safety of children in care.
Family home — safe toys and play equipment — Based on LPA Yang Yang’s observations, photographs, and video taken on 3/23/2023 of the outdoor play area of a canvas shade structure that had fallen over and lying on its side, a 2’ metal landscaping stake lying on the ground, two Pac ‘n Plays that were heavily damaged and strewn about the outdoor play area, the fence located on the right side of the outdoor play area leaning toward the neighbor's yard and a heating and/or air conditioning unit with exposed wires.
