Personal Rights: To be free from corporal or unusual punishment...or other actions of a punitive nature, including, but not limited to: interference with eating, sleeping or toileting; or withholding shelter, clothing, medication or aids to physical functioning. This requirement was not being met based on information obtained that the licensee did not comply with the section cited above. It was determined that some children would be told to stand at a wall as discipline however, at times the children would be left there/forgotten for an unspecified amount of time. This poses/posed a immediate health, safety or personal rights risk to children in care.

(d) All individuals subject to a criminal record review... shall prior to working, residing, or volunteering in a licensed facility: (1) Obtain a California clearance or a criminal record exemption as required by the Department... Based on observation, interview, and record review, LPAs observed A1, who does not have criminal record clearance, walk a child from a car to the inside of the house which poses an immediate health, safety or personal rights risk to persons in care.

102416.5 Staffing Ratio and Capacity (a) The capacity specified on the license shall be the maximum number of children for whom care may be provided at any one time. This was not met as evidenced by: Based on pertinent documents reviewed by CCLD, the Licensee exceeded the terms of their License and operated the facility over capacity. Licensee had 15 to 18 children in care for 10 days. This is an immediate health safety or personal rights risk to children in care.

(c) The family day care home shall maintain documentation of the required immunizations or exemptions from immunization, as set forth in this section, in the person’s personnel record that is maintained by the family day care home. Based on interview and record review, the licensee did not comply with the section cited above as A1 was missing proof of the measles immunization, pertussis immunization, and influenza immunization/declination which poses a potential health and safety risk to persons in care.

(b) (9) Evidence of a current tuberculosis clearance, not more than one year prior to or seven days after initial presence in the home, for any adult in the home during the time that children are under care. Based on interview and record review, the licensee did not comply with the section cited above as A1 did not have proof of Tuberculosis (TB) clearance that meets regulation requirements which poses a potential health, safety or personal rights risk to persons in care.

(b)(3) On and after January 1, 2018, a... employee of a licensed child day care facility shall complete the mandated reporter training... and shall complete renewal mandated reporter training every two years... Based on interview and record review, the licensee did not comply with the section cited above as A1 did not have proof of the Mandated Repoter Child Care Providers certificate (AB1207) which poses a potential health, safety or personal rights risk to persons in care.

(1) Commencing September 1, 2016, a person shall not be employed or volunteer at a family day care home if he or she has not been immunized against influenza, pertussis, and measles.... This was not net as evidenced by: Based on observation and record review, the licensee did not comply with the section cited above, LPA was unable to verify Staff's immunizations records, Licensee did not obtain immunization records from previous citation which poses a potential health, safety or personal rights risk to persons in care.

Mandated reporter training — Based on observation, interview and record review, the licensee did not comply with the section cited above, Licensee's Mandated Reporter Certificate has expired, Staff's Mandated Reporter Certificate was unavailable for review, which poses a potential health, safety or personal rights risk to persons in care.

Staff immunization — influenza, pertussis and measles — Based on observation and record review, the licensee did not comply with the section cited above, LPA was unable to verify Staff's immunizations records, which poses a potential health, safety or personal rights risk to persons in care.

Immunizations — Based on observation and record review, the licensee did not comply with the section cited above in one out of five children's records reviewed was missing immunization records, which poses a potential health, safety or personal rights risk to persons in care.
