The licensee was observed yelling at the children in the kitchen while the LPA was standing outside.

1597.465 Large family day care homes; number of children - A large family day care home may provide care for more than 12 children and up to and including 14 children, if all of the following conditions are met: (b) No more than three infants are cared for during any time when more than 12 children are being cared for. Based on observation the licensee did not meet the regulation above in 1 of 4 infants present. The licensee had 13 children, including 4 infants.

The licensee did not meed the regulation above as evidenced by: Based on observation, the licensee did not meet the regulation above in 4 out of 4 cribs, which poses an immediate risk to the health and safety of infants in care. LPA observed 4 cribs with loose articles inside. Three cirbs had one infant under 12 months inside.

102417(a) Operation of a Family Child Care Home. ... When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children. The licensee did not meet the regulation as evidenced by: Based on interviews with the licensee, S1, C1, C2, Adult1, Adult 2, and records review, the licensee did not meet the above regulation. The licensee did not ensure the children had adequate supervision which resulted in inappropriate interactions between child 1 and child 2.

Infant Safe Sleep — Based on interivew and records review, the licensee did not document the safe-sleep logs for infants C1, C2, and C3. The licensee stated she could not find the most recent logs. Older logs were observed in file. This poses/posed a potential health, safety or personal rights risk to persons in care.

102423(a)(2) Personal Rights. Each child receiving services from a family child care home shall have certain rights... : (2) To receive safe, healthful, and comfortable accommodations, furnishings, and equipment. The requirement was not met as evidence by: Based on observation, the licensee did not ensure that children were separated in age groups as agreed in the Legal/Noncompliance Conference held on 2/7/24. This poses a potential risk to the health, safety, or personal rights of children in care.

Mandated reporter training — Based on records review the requirement was not met for 1 of 3 staff present at the facility, which poses a potential risk to the health, safety, and personal rights of children. S3 did not have a valid mandated reporter. The mandated reporter in file is not approved by the department.

The licensee did not meet the regulation above as evidenced by: Based on records review and interview, the licensee did not comply with the above regulation on 2 of 2 volunteers, which poses a potential risk to the health, safety, or personal rights of clients. The licensee did not have immunization records for A1 and A2.

Administration of Child Day Care Licensing. ...a childcare provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training … The licensee did not comply with the above regulation as evidenced by: Based on records review and interview, the licensee did not comply with the above regulation, which poses a potential risk to the health, safety, or personal rights of clients in care. The licensee stated A1 and A2 did not have a current mandated reporter certificate.
